The court of appeal has thrown out a ruling made last year that any hormone treatments, including puberty blockers for U-16s, could not take place without court approval. This led to the main trans health centres ceasing any referrals and medical provision for trans teens.
The lord chief justice, Lord Burnett, Sir Geoffrey Vos and Lady Justice King said today it had been “inappropriate” for the high court to issue the guidance.
"The appeal court judges stressed that it was established legal principle that “it was for clinicians rather than the court to decide on competence [to consent]”.
The initial case was brought by two people who had subsequently de-transitioned, citing possible irreversible fertility changes. Hormone blockers do not affect future fertility so it was frustrating and malicious to suggest otherwise.
