The Department of Justice has decided that Rep. Mo Brooks was not acting in his official capacity as he delivered remarks at a rally with former President Trump on January 6. This means he is not shielded for a lawsuit brought against him by Rep. Eric Swalwell for allegedly inciting the Capitol riot. NBC's Pete Williams has details.

I like the finding that Brooks was not acting in an official capacity. It puts the Seditionists on the dias that day, including Trump, on their own dime.

They already are. Brooks has done a lot of whining about how Swallwell ambushed his wife at home with the summons for the lawsuit - after Brooks himself proved cowardly but good at dodging it.
