Hard to argue with that assessment. Did they really find 175 pounds of marijuana in his trunk? Why would someone handed opportunities few can even dream of throw it away like this?

DALLAS -- Former Cowboys lineman Nate Newton's lawyer said Thursday that his client is not guilty of possessing 175 pounds of marijuana.

"Nate maintains his innocence and says he's not guilty," attorney Howard Shapiro said after Newton's initial appearance before a federal magistrate on the drug charge. "He's made mistakes in the past, but this was not one of them."

Newton, 39, told the magistrate that he understands the charge against him. Newton and two others were arrested Wednesday while driving in two cars south of Dallas. It was Newton's second drug arrest in the past two months.

Shapiro said the marijuana was not in the car Newton was driving, and that Newton wasn't aware of the drugs.

Newton was held without bail at the Lew Sterrett Justice Center on Thursday on a federal charge of possession with intent to deliver marijuana, Dallas County Sheriff's Department spokesman Don Peritz said.

A detention hearing was set for 2 p.m. Friday for Newton, who remains in custody. Shapiro said Newton is not a flight risk, and that he will ask the judge to set bail tomorrow. Prosecutors do not want Newton released.

On Nov. 4, Newton was arrested in Louisiana after police said they found 213 pounds of marijuana in a van he was driving. He was released on $100,000 bond on charges of suspicion of possessing marijuana with intent to distribute.

Phil Haney, the prosecutor in the Louisiana case, said Newton will probably be arraigned there in January, but that his latest arrest could affect the case.

Newton, who lives in East Ellijay, Ga., is a six-time Pro Bowl offensive lineman who helped Dallas win three Super Bowls. He spent 14 seasons in the NFL, 13 with Dallas. He retired last year after a season with Carolina.

IMHO, yes. There are tons of athletes that get caught with drugs, but most only have small amounts.

in many states possession of weed is a misdominer... not a big deal really. however if you have a lot... say 175 pounds... then it is concidered possession with intent to sell, which is a much bigger deal. at least that's my understanding of how it works in california.

That's the basic rule of thumb. Most states have an actual weight amount (in grams) under which the charge goes from the misdemeanor possession charge to the felony possession with intent. Once you hit that threshold, the law assumes that what you have is no longer for personal consmption, and that you're going to deal it. It's an automatic thing and the police pretty much have to charge you with it.

It's often plea bargained down to "simple" possession, if the defendant's record is fairly clean. Newton's isn't. He could be facing time for this charge.

It is packaged into more than one parcel
measuring paraphernalia is also found
large amounts of cash present

I'm sorry, I just don't see this whole intent to distribute thing, I mean, we're headed into the winter, right? Nights are long in Ellijay, GA, and they don't even have cable. (I've been there once, but it was a while back now.) What's a guy supposed to do, masturbate?
