I am curious. I am working on a story that involves this pairing, and I wonder if it is incest, or would be concidered incest on this site?
Is sex between a step father and a step-daughter incest?

Remember this is the WWW and once you move from siblings and parents, direct blood lines, it is a matter of definition. What is legally incest in one society will not be in another.
If it feels like incest to you, if your story has the moral dilemas that are a part of the incest genre it is incest - if there is no moral / ethical dilemas to resolve maybe it would sit better in Mature.

I say yes
I've not written anything for the incest category (yet). But just from my own perspective, it is incest if the older person in the story was in a position of parental-type authority over the younger person.

Very good answer. (In my state, it is illegal, but sex
between a step-brother and his step-sister is legal;
half-siblings are still illegal.)

was illegal in teh West. (And more extreme cases than
OTOH, one sister of an Eastern emperor stood godmother
to a woman who was being baptized so that that emperor
could marry her. So, the Eastern church didn't seem to
recognize that realationship as any block.

In the strictly "legal" sense, if both parties are over the age of consent, both parties consent to the union and no coercion can be proven then no, it's generally not illegal. (Some US states and other places ban it, however)
Morally, however, is a subject unto itself as Jon has pointed out.
For me I was swayed by "popular" opinion before deciding on an idea for a firt story. Seeing how popular the incest category was, (to my astonishment), I decided to try that. After reviewing nearly every titale and subject I decided on a "step" type sexual encounter. Unfortunately the story has been very well received and I've been urged by a lot of people replying to carry on.
Having no children or stepchildren made it somewhat easier since I had no personal close, personal reference to feel guilt, angst etc about.
But the point raised by Goddess is probably right on the money. Anyone in a parental role must exercise a lot of authority to the "child" whether they be 18+ or not.
I've tried to handle the series of stories, from the outset, in a blaringly consensual tone. Even then I felt compelled to show a decent degree of "angst" at what the main character was doing.
Though the premise for the incestuous relationship is pretty unbelievable as people have commented it was one way for me to overcome the reluctance to write on this subject.
Might I suggest you look at it and tell me what you think. I'll IM the url to you, not shamelessly promoting myself here after all.

Maybe I got that wrong but wasn't the question wether it's incest or not and not wether it's legal or not?
I'd say it's not incest because this only means the intercourse between blood relatives. It basicly has nothing to do with society restrictions. Still it could lead to the same moral problems (and here we are in society again)

The legal issues concern incest, which is illegal almost everywhere.
What drives these laws to include non-blood relatives is the issue of for want of better words, "moral terpitude".
The basic premise being that a stepparent, in a position of authority, can excercise much influence on a step child, in a position of subservience, and therefore hold a position of power that denegrates the child into complying with the wishes of the parent. (Reagardless off the ages involved)
Tough one to call Jubilee, more thought and discussion perhaps!

Reading the posts, as someone who both reads and writes incest stories I want to make a couple of points.
We are talking about a work of fiction - not should a person commit incest or not. I don't think anyone will either be inspired or detered from doing something on the basis of our fiction.
I read incest because unusually for erotica or porn it has the cliffhanger - if an author does not include the moral dilema the story is simply another "bonk" account and I for one click it off.
It is the erotic plotline on a par with Romeo and Juliet for the Romance writer.
I think in those terms even a story about a young guy and his mother's best friend would qualify. - So long as the dilema is present. - eg he had always called her Aunty Jane and now on the day after his 18th birthday party, (still hungover) he stumbles into the bathroom without knocking - she is in the shower ....
You know the rest. Let's keep writing interesting stories and not worry about the legal niceties. Its too complex.
e.g. The Church of England was founded upon Incest - Henry VIII married his dead brother's fiancee - when he wanted a divorce he discovered under cannon law this was an incestuous relationship.

your totally right. Sex between stepfather and stepdaughter remains illegal (at least in most countries) AND the moral aspect remains, though it would not be seen as incest.
But as it brings the same aspects (and thrills) with it such a story should be placed into an incest category.

Hi I have seen a few stories along this line and is a good one to explore not sure if its illegal if the step daughter is not adopted legally I do know one case local to me that after the death of the mother the step farther and daughter got married

Actually I was not concerned about legality. I am more wondering if the readers at Lit would think it fits into the incest category.

Personally I have no problem reading a step-child/step-father story in any category, but I have never looked at the incest stories before. I read a thread here or there about an incest story getting like a zillion hits in one day, so it sounds like you'd probably get more readers if you categorized it that way. You could always re-submit it if you changed your mind or got any complaints.
