The answer isn't dependent on timing. SCOTUS already addressed the question which applies today as well as tomorrow as well as yesterday.
 
That was settled many years ago. Its looked at as Freedom of Speech. The Supreme Court ruled on it.

Now, while you're tying your undies in a knot answer this question.

I go down to the Police Station and take a picture of the flag flying. Then I go home and print a copy of that picture.

Now...are your undies tied tight yet?

I go out in my front yard and put a match to the printed pic of the flag at the Police Station.

Are you still thinking that I burned the flag? The flag is a symbol. Whether its made of printed sheet of plastic or sewn out of bunting...its still a symbol.

(1) A person is guilty of malicious mischief in the third degree if he or she:
(a) Knowingly and maliciously causes physical damage to the property of another, under circumstances not amounting to malicious mischief in the first or second degree; or
(b) Writes, paints, or draws any inscription, figure, or mark of any type on any public or private building or other structure or any real or personal property owned by any other person unless the person has obtained the express permission of the owner or operator of the property, under circumstances not amounting to malicious mischief in the first or second degree.
(2) Malicious mischief in the third degree is a gross misdemeanor.
