Indiana high court lets gay adoption stand

INDIANAPOLIS - Indiana's Supreme Court let stand a ruling that allows unmarried couples, including those of the same sex, to adopt children through a joint petition that gives both partners equal custody.

In a 4-1 decision posted Friday, the high court refused to hear arguments in the case. That left in tact the April ruling by the Indiana Court of Appeals, which had overturned a lower court's ruling that state law limits adoption to married couples and individuals.

"The court acknowledged that two people can create a caring, stable, loving home for children without being married," said Patricia Logue, senior counsel for Lambda Legal's Midwest office in Chicago. "Not only is this a decision that will keep our clients' family intact, but this is a victory for the thousands of children in Indiana desperately in need of a caring home."

Logue represented a lesbian couple from Morgan County whose 2004 attempt to adopt a baby girl was approved by a judge in one county but denied by a judge in another.

Attorney General Steve Carter had hoped the state's highest court would overturn the 2-1 appeals ruling.

Carter's aides did not return messages left Friday by The Associated Press.

This is good news, but I live in Indiana. I assure you, they will eventually fuck this up.

I too live in Indiana ... and agree... someone will mess this up, it is just a matter of time.
 
I can only hope this is a decision for common sense that will last. I'm trying not to think of the knowledgeable pessimism of Indiana's residents (above).

'Tis time to put religious and sexual discrimination aside and think of the children.
 
I'm going to have to add yet another local voice saying they'll doubless make a mess of it in time.

I need only look at the travesty that is DST in Indiana to be assured of that. Overall, the concept of "do it right the first time and then leave it the hell alone" is lost on the elected officials. They either do it all wrong ( Daylight Savings ) or muddle it up later.

Absolutely TRUE. We lived in Indianapolis briefly, but then left because of their government's great batting average of fucking things up royally. The "powers that be" there love to pat themselves on the back in press releases, but then stab their residents in the same place when it comes time to do what they said. It's all smoke and mirrors. The saddess part of it all? There's a lot of really nice folks living there.
 
Regardless how it turns out, so far it's a win-win situation. The people who want to adopt can do so and there are more potential parents, so those kids who need homes have a better chance of getting them. :D

I'm afraid this will be challenged in the U.S. Supreme Court before it's settled. Personally I praise the Indiana Court for the decision, however, with the conservative U.S. Court it is a toss up as to how it comes out.

I like this part of the article.

In order to overturn this, won't the opposing rabid right-wingers have to present evidence to the contrary?

John Roberts Conserviative, Anti Gay, Anit Abortion
Samuel Alito Conservative, Anti Gay, Anti Abortion
Clarance Thomas Conservative, Anti Gay, Anti Abortion

The other six Justices could swing either way. Any 2 who appose would strike the ruling down. Unfortunately I think that is likely and I can imagine any number of arguments they can use to bring it to the High Court :(

I don't think they can appeal it to the US SC as the Indiana SC refused to hear arguments thus affirming the lower courts finding.

They(Indiana) would first have to take it to the Federal Appelet courts system before going to the US SC which would be a costly venture for the state.

Even if the ruling is eventually overruled, it is still a chink in the wall, and may eventually become a doorway. :D
