OK OK i know I have told a few lawyer jokes in the past....I also trash truckdrivers and I am one....

So here goes...

My daughter was involved in an auto accident in May. She was a passenger in a car driven by her boyfriend(?). He crossed the highway and did not see the car coming from the right..and wham they got T boned right where my daughter was sitting...short story...Broken pelvis, three places.

The breakdown:

1 Missed last week of school

2 Had to attend graduation in a wheelchair in a LOT of pain

3 Spent 5 weeks basically confined to the recliner in living room including 18th birthday

4 Complete loss of dignity and modesty..(I doubt many daughters are comfortable with their fathers helping them in the bathroom and getting in/out of the bath)

5 Missed work...consequently had to borrow money from grandparents for college

6 Missed all summer activities softball

7 Still has aches and pains in the hip after walking around for the day

8 May,not certain though, need surgery to fuse the pelvis someday in the future..(her Dr. said this)

9 Will be a year before she can engage in any sports at college..


So here is what the insurance co offered...10,000 for it all

Am I outta line for thinking this is way low? I, and my daughter are not looking to get rich off this...I need to know what is feasible and maybe where to look...
We haven't consulted an attorney..yet, I didn't want to take it that far..the boy and his family are good people and I don't wanna drag them into it..but I don't want to sell my daughter short either...

Wow, sounds kind of low to me. I'd talk to a lawyer. It really doesn't matter how nice the boy and his family are. If they really are 'good people', they'll understand that it is nothing personal. I'm not really one to push suing, but this seems like a case where the insurance company is...I don't want to say intimidate you...maybe sucker you, into accepting a low offer.
 
$10,000, is that it? I'm not an attorney, but that seems outrageous. Sue the bastards!

IT does sound quite low Thumper. An important item to me would seem to be what are the expected medical and rehabilitation costs for the next year or so, plus the current medical costs??????

Thankfully, it sounds as if your daughter is okay though, Thumper. I'm definately glad to hear that.

Actually...

She is doing quite well...she just has to walk a lot at college...which is good...no debilitating pain just a n ache at the end of the day
Medical bills have been paid and the Doc has released her barring any new developements. No therapy other than getting daily "gentle" exercise..I just want to safeguard her future..she is only 18

Don't get me wrong...I am so thankful she is still here...we are extremely fortunate..I don't let myself forget that ever..

Glad your daughter is ok...

I think that sounds low too, Thumper. My sister-in-law got a $32,000 settlement for a car accident that broke her jaw bone. That injury didn't involve much rehab or special treatment just her jaw wired shut. Still that didn't affect her job, school or even her eating habits that much, though she did miss hamburgers I'm told. See a lawyer and see what he/she says. It can't hurt anything.

Thumper, I'm sorry to hear about your daughter. I'm glad she's alright.

You really need to talk to attourney. $10,000 is ridiculous, that would barely cover medical expenses in many cases.

I'm not advocating a frivolous lawsuit, but she was injured and is entitled to compensation. This is why everyone must carry liability insurance.

Was this the insurance company's first offer? I'm willing to bet they don't want this to go to court because they know the settlement should be higher.

Anyway, give her a hug and send my best wishes!

$10,000 sounds low ... and I am not sure how things work in the States ... but what about legal costs to fight the settlement? and time in court, etc. ... damned if you do and damned if you don't ...

Things in the US usually happen along the lines of insurance making a pitiful offer, victim retaining counsel, insurance either offering adequate settlement before court, including all expenses legal, medical, and a small amount for punative -OR- insurance fighting tooth and nail all the way through.

Of course each case is different, but I've seen $25,000.00 go to a guy who was only able to prove a broken finger(!) and whiplash. Go figure!

If the fault is clearly the other party, they will usually settle with less hassle.

Give her lots of *hugs* and some MSM for the joint pain that's on its way.

I would say you need to obtain an attorney...I talked to my brother-in-law who's an attorney and he said that $10,000.00 is an insult. You need to obtain an attorney and not only go after more money for pain, grief, and injury but try to get something in writing for any medical to be covered for the rest of her life that might be relating to this injury. Who knows what may take place as she gets older! Anyway, at least she is mending and I am glad she is okay but, you need to look out for you and yours because the insurance isn't thinking of her they are looking to get out as cheaply as they can.

Good luck! She's lucky to have such a wonderful father to support her!

Let me join the chorus Thumper. Get an attorney, give him all your documentation and medical records, and say "sic 'em."

$10,000 is definitely a first offer, hoping that you will be ignorant enough to take it. However, you won't be able to arrive at a fair compromise without an attorney to scare them.

In 1994 my youngest boy was a passenger in a car with a friend.
They where coming home from school when a lady made a left hand turn in front of them,and hit them headon.

He had a broken leg,and hip,and a couple of fractured ribs.The other boy that was driving had a concusstion,and a broken shoulder.

The insurance co. offered $20,000 to both of the boys.The other parents and I retained an attorney.
After all was said and done,the 2 boys got $100,000 each.
Since my boy was a miner at the time,we had it set up in a payment plan.After attorney fees he received $66,000.So on his 18th birthday he received a check for $20,000,and the same on his 19th and 20th.Next year he gets his last one for $20,000.
By putting it into a account like that,and spreading it out over time like that,he made an extra $14,000.

Well whatever you do,I'm glad to hear that your daughter is all right.
I know what it's like to get that phone call.It scares the shit out of you.
21 years ago our daughter passed away,and I don't know if my wife or I could handle losing another child......Good Luck!..Later!
 
Thumper so sorry to hear about your daughter.

My wife and 5 year old daughter in accident almost three years ago. Just got settlement and it barely covered meds and time and energy spent. However without a lawyer you can just expect to get shafted. They should know what you can expect in way of settlement. It will take most of the extra money to pay the lawyer as here in Texas it is around 1/3 of total $. You should get money for meds, work time missed, maybe even school time? plus some for pain and suffering. If you do use an attorney please use a good one that handles this type of case as most of their case load.

Thumper I hope that your baby is doing okay in college. It is a big step to go from high school to college but a fun one if you can just keep up the grades. Dang they growup so fast, just a little kid running around the house one day and a grownup woman the next.

No this is not a shameless attempt...

...at reviving my own thread. I just wanted to thank everyone for their kind words. I am seriously leaning towrds hiring an attorney. I was just wanting to get a figure in mind in case we try to negotiate a settlement before going that route. My daughter says she wants nothing less than 50G's. Mercenary little wench!:D This guy doesn't know what he is up against with her... I pray for his soul.
