I Got Screwed!

Ok, now that I have your attention, I need to ask a question and I hope that someone of vast knowledge can help me.

I think I got screwed.. and not in the deliciously yummy sort of way. I bought a brand spanking new car (2001 Kia Rio) last week, and it's affordable so money's not the issue. The problem is, I think I made a mistake in choosing the type of car it is. I was told by the dealer (after I already signed the contract)that there is no such thing as 'buyers remorse' when buying a car. That once I sign the contract, thats it, the car is mine. Can someone please verify that there is no 'buyer's remorse' law in Oregon (USA), I have no clue where to even begin researching this specific subject. All I know is that with most contracts, theres usually a 72 hr grace period for backing out. Help?

A call to thge state Attorney General's office will be the easiest way to find out if such a law exists in Oregon.

I'm pretty sure very few states have that law. I know in WI where I live, a contract is binding as soon as your signature is on it, and that it obligates you to buy the vehicle. At least that's how it is here, Oregon may be different. If that's the case in your state, they may let you out of the contract, but it could cost you.

I knew there were some people here that were attorneys or lawyers or something, I figured this was a good starting point. Unfortunatly Siren, I bought the car last Tuesday, so that 3 day period would be over. I was thinking/wondering though, if I could get the salesman in trouble for lying to my face about the situation. I like the car, I just didn't realize how SMALL it was inside w/ me and my 2 kiddies, they weren't with me when I bought it. Oh well, thats on my ignorance I guess. I'm just glad we're a bunch of shorties.

The much-talked-about three day grace period on sales contracts only applies when you make a purchase in your home from a salesperson who calls on you. If you go to a retailer and sign a contract, you're bound immediately.

If the salesman made a material misprepresentation about the car, you may have grounds to void the sale. However, if the alleged misrepresentation is the lack of interior room in the car, you're SOL. That was clearly obvious to your sight and available for you to examine.

Another one? I'm starting to think lawyers are a higher percentage of porn site participants than their population percentage in the RL. Don't have any clue what that means though....

I knew you were screwed the minute you said Kia but that's beside the point. I tell you if you can, you really ought to return that vehicle, not because of the type of car it is, but because you don't want to do business with that type of dealer. It sounds pretty unethical to me that he would tell you something like that. I know where I am from you have either a week or a certain amount of miles, whichever comes first and most dealers do have that rule. I would defintely check out your state law.

Never, I knew we had a lemon law cuz thats what the salesman said after I signed the
contract, ‘No buyers remorse, but there is a lemon law.’ Here’s the kicker, 2 days after
buying it, the check engine light came on- but see, Kia has this nifty 5 year or 60,000
miles warrenty thing.. so if I did get a lemon, they’d fix it.. I took it to their mechanic,
but he couldn’t find anything wrong in an hours time. So he told me to bring in the car for a
whole day.. if I had known having a new car would have been this much of a hassle I
would have kept the hunk-o-junk..

Dudley, thas ok hon, we’re all here to have some fun..to get away from real life a bit. But
thanks for giving me some of your insight from the real world. Thanks to all of you for
the advise. I believe what Dudley was saying to be true, I hunted around on the net from
that site Siren gave me.. and all I could find on buyers remorse in Oregon was related to
real estate.. oh well.

Right answer, I believe. But why did you telll them you're a lawyer, especially after seeing their bias on this BB? Well, maybe you can now become the focus of their taunts while I rest up.

Oriental version of Citroen?

Never owned a Kia (you have to assemble them your self but they cost a little less;)) but I have yet to hear of a positive experience from any one who has.

Lickerish, I just know for a fact, or at least in the DC area, those cars have higher insurance rates because they are so cheaply made. If you ever get into an accident witha Kia it's likely to crumple like an accordian. The insurance is high because when those types of cars get into accidents it's better to just write them off and scrap them as opposed to getting the damages fixed. If you got into a collision with an SUV for instance, your car is toast, not to mention that the Kia sportage is ranked up there near the top as far as SUV turning over.

Damn damn damn damn, I am an idiot. Anyone know of a support group? I always make these stupid decisions. All I know was that the newspaper said they were inexpensive and that they have good gas milage. My insurance isn't too bad, $75/mo as opposed to my hunk-o-junk '85 Chevy Blazer at $65/mo.

Expertise, were you saying that our own 'Never' owned a Kia, or that you never owned a Kia??
