Miami judge rules against Florida gay adoption ban

MIAMI - A Miami Dade Circuit judge ruled today that a gay man and his partner should be able to adopt the two foster children they have raised for four years.

Circuit Judge Cindy S. Lederman "these children are thriving. These words we don't often hear within these walls. That's uncontroverted," said Circuit Judge Cindy S. Lederman.

"They're a good family. They're a family in every way except in the eyes of the law. These children have a right to permanancy," the judge said. "The only real permanancy is adoption in the home where they are thriving.

"There is no rational basis to preclude homosexuals from adopting," Lederman continued.


In 2004, the state encouraged Gill and his unidenfitied male partner to provide a foster home for two boys. Gill wants to become their adopted father.

"Today I've cried my first tears of joy in my life," said Gill, 47, a flight attendant who lives in North Miami. "We are elated." Gill added: "I wasn't here to make history. I was here to do the best thing for a 4- and an 8-year-old."

A lawyer from the Attorney General's Office, who is representing the state Department of Children and Families, said the case would be appealed.

Some states, such as Mississippi and Utah, prevent gays from adopting by using laws that prohibit unmarried couples from adopting. But Florida expressly targeted gays with its 1977 law, enacted during Miss America runner-up Anita Bryant's anti-homosexual crusade.

Florida Statute 63.042 states: "No person eligible to adopt under this statute may adopt if that person is a homosexual." They can be state-appointed foster parents. They can be named permanent guardians. But adoption is not allowed.

Gill's attorney, Robert Rosenwald of the American Civil Liberties Union of Florida, said an appeals court and the possibly the Florida Supreme Court would be asked to address the ban on gay adoption.

Yeah, for the dads, but most especially for the kids! :D

But a sad yeah, when I read comments like this from a judge and STILL the fucking Department of Children and Families is going to appeal. The DCF should be renamed the Department of Bigots and Uncaring Assholes! :mad:
 
Fantastic! Common sense is a scarce commodity these days, and it's good to know it's still exists in some courtrooms.

So many children are without families...denying Gay and Lesbian couples the right to give them a loving home is sheer idiocy...and bigoted.

Hetero couples aren't always the best foster parents either. They're people just like Gays and Lesbians are people. The same successes and the same failings are common to all.

I hope this does go to the Supremes and they stick a finger in California and Utah's eyes when they rule in favor of the plaintiffs. :D

Waidaminit, waidaminit. Gays can adopt in California, teach elementary school, be police officers and everything else . . . just not get married . . . YET!

No, that acronym is too hard to say. Just keep the same letters and call them the Department of Cluster Fucks.

I worked for DCF many years. And I can tell you plenty of stories about faggot foster dads.

I remember a guy named STEVE. STEVE used to call us on Fridays, begging for a boy. I told STEVE we werent eHarmony.com for pedophiles.

So STEVE sued DCF and me, because I wouldnt send him any teenage boys to add some zip to his weekend. I told the court and STEVE'S lawyer that I dont have to furnish anyone with a quota of kids...end of story. His lawyer tried to paint me as a homophobe, and my response was TRUE! BUT THE LAW LETS ME DECIDE WHO GETS A FOSTER KID, AND HOMOPHOBE DOESNT DISQUALIFY ME. Stick that in your ass.

Gay men make up 5% of the population and generate 33% of the sexual abuse.

The judge in Miami is a prominent idgit and her decision will result in another constitutional amendment unfriendly to Gays.

Then you can piss & moan about that.

Hmmmm....I can think of at least 3 women in my own personal circle that were sexually abused by their heterosexual BIOLOGICAL fathers when they were young.... Should we raise our eyebrows at all men then; and question their motives for having/wanting children???

Wonder how many foster children have been abused by heterosexual foster dads (or moms). Bet there have been quite a few. Actually, come to think of it, my friend in high school ran away from her foster home because she was raped by foster dad.

Makes me so freaking mad when people think sexual preference has anything to do with being a good parent. For example: say I liked to spank people...consenting adults...should I be deemed an unfit parent because of what I choose to do in the privacy of my bedroom? Does it mean that I will be violent towards my children? Fuck no. That is just rediculous.

I believe that children deserve loving homes...period.
 
Maybe FL can stop being the state that cannot figure out how to unhang a chad and be the state that finally told EVERY child you are adoptable. :rose:

Lotsa experiences with Gay perps, and you can read David Finklehor's research; he wrote the book on sexual abuse.

But even if the research didnt exist, youre forced to wonder why any unmarried male would want custody of a teen or any child unrelated to him. I cant recall one straight, male foster parent. Straight males cannot be bothered with kids.

Lesbians are different.

I cant recall one lesbian who wasnt a fit and appropriate foster parent. Lesbians did it for the extra income.

Sexual orientation makes a big difference.

DCF is filled with lesbians. Talk to a few lesbian social workers and hear what they say about male foster parents. I had lesbian supervisors who told me straight out NO FUCKING WAY is that guy getting a kid.

I have no idea why intelligent people expect a gay man to be any different from a single straight man. If youre uncomfortable with the idea of a straight guy fostering your daughter, why would you be okay if your son was with a gay?

The court order wont stand because everyone associated with adoptions and foster care know what the deal is.

Hells Bells, we had a judge here who married a 15 year old girl and her 25 year old sexual abuser. Grandma refused consent and the judge married them anyway.

Yep, youre right. I wouldnt want my daughter placed with an unmarried guy, and you damned sure wouldnt want your son placed with an unmarried gay guy. Unmarried males are not eunuchs.
