The U.S. Supreme Court let stand on January 10, 2005 a ruling that the Ku Klux Klan can take part in Missouri's 'Adopt-A-Highway' program in which volunteers pick up trash along the road and the state puts up a sign thanking the group. Without comment, the high court rejected Missouri's appeal of a U.S. appeals court ruling that declared the state had violated the Klan's constitutional free-speech rights. A sign announcing the Klan has adopted a one-mile stretch of Interstate 55 in south St. Louis County is erected in this December 1999 file photo.

Supreme Court Sides with Klan in Adopted Highway Program

WASHINGTON - The U.S. Supreme Court let stand on Monday a ruling that the Ku Klux Klan white supremacist group can take part in Missouri's "Adopt-A-Highway" program in which volunteers pick up trash along the road and the state puts up a sign thanking the group.

Without comment, the high court rejected Missouri's appeal of a U.S. appeals court ruling that declared the state had violated the Klan's constitutional free-speech rights by rejecting its request to adopt a portion of a highway.

Missouri cited the Klan's history of violence and said the group's application showed it "denies membership on the basis of race, color or national origin."

The original Klan was founded after the Civil War in 1865 by former Confederate soldiers to oppose federal reconstruction efforts. Later versions of the Klan violently opposed the civil-rights movement of the 1960s.

In Mississippi last week, suspected local Klan leader Edgar Ray Killen was charged with the 1964 murders of three civil-rights workers, one of the most notorious civil rights-era crimes in the United States. He pleaded not guilty.

Under the highway cleanup program, volunteers agree to collect litter at least twice every six months and put it in bags that state employees pick up. The state puts up signs acknowledging the help at both ends of the section of the highway the group has adopted.

Missouri appealed to the Supreme Court. It said it wanted "to avoid giving motorists the mistaken impression that the state has anything good to say about a horrific, racist group."

State officials warned of problems if the Klan succeeds in forcing the state to allow them into the program.

"Given the KKK's reputation as a hate group, it is reasonable to anticipate that taunts, jeers, insults or objects would be hurled at KKK members picking up trash near the road," they said.

The officials said some people might intentionally dump trash along the road to create more work for Klan members. "The Klan's involvement could lead to more trash along the highway, completely defeating the purpose of the program."

Alabama, Arkansas, Hawaii, Illinois, Kansas, Maryland, Oklahoma, Pennsylvania, Texas and Vermont all supported the appeal.

The high court's rejection of Missouri's appeal marked the second time it had considered the issue. It denied a similar appeal by the state in 2001.

I don't think that should have put the sign up and I don't think that the state should have allowed them to even adopt the highway to begin with. It does not seem right for the state to accept money from hate groups such as that.

...as long as they don't hang anyone from the sign.

I mean, constitutionally, what can one do to stop it?

If someone just keeps taking it down, surely they will get tired of putting it back up. In this case, some mild vandalism is A-OK with me.

In Cincinnati, OH, the Klan is allowed to put a wooden cross up at the city square at Christmastime.

A FUCKING CROSS!

...one of the reasons I moved.

I can only say that I am glad that the freedom of speech is upheld.

The KKK may be antifreedom organisation, but they still have the freedom to say what they want and to pick up garbage on the side of the highway.

I wonder what happens if they neglect their trash collection duties.

The KKK definitely DOES have the right to freedom of speech. Absolutely, beyond a doubt in my opinion. They should be able to adopt a highway and people shouldn't be allowed to throw shit at them. At least not when the cops are looking...

....so some people don't want an in-print reminder that the group even exists. For decades that group terrorized an entire population and now claims to have never participated in such events.

Would you care if Al Qaeda wanted to adopt a highway? If not...right on.

i agree

and i hope that people do make their work more difficult

there are ways groups can be persuaded to quit, even if the courts don't enforce it

I wouldn't care. Long as they don;t put landminds along the road.

I think it is a dumb idea to ignore hate groups. Flush them out in the open, and let people see them for what they are. You will do a better job that way.

can you give me a good reason as to why the courts shouldn't let them? you know outside of you not liking it.

Some people involved in hate groups feel that acknowledgement is a substitute for acceptance and that their actions are condoned. (sp?)

I'm all for freedom of speech, but allowing the KKK to adopt a highway still seems wrong.

sure and i feel the sameway if a Christan group did it. Its not like i would now be driving on Gods highway. But they have that right to adopt a highway.

Long as it stays clean

If you expose them for what they are, they will wither up and die. The Klan has just as much a right to pick up trash on the side of the road as any other group and picking up trash is probably all any of them are any good at doing.

I doubt the sign will last long, I am sure it will be the target of numerous acts of vandalism.

because they support and promote hate and violence
they do not believe in the equality of human beings and they have a history of commiting violent acts against others as well as are responsible for still terrorizing non-white families that move into certain neighborhoods

i don't think a group like that should be allowed to promote their hate
nor be praised for cleaning up the road

you cannot compare christianity to the KKK, that's ridiculous

My other question is this....Is this actually being honored? I mean, anybody can adopt a piece of highway and pick up trash. This isn't exactly getting the keys to the city.

yes, they were supported by the Supreme Court

if the KKK wants to do something impressive and honorable, why don't they go clean up the parks and schoolyards of underprivileged inner city youths

or invite the NAACP to co sponsor a clean up program

Nah, they're not being honoured. Just tolerated.
