Ok, this is a continuation from my thread entitled "I got screwed!!" I need some buku help and have nowhere to turn and thought I'd try getting advice here.

To re-cap, I bought a 2001 Kia Rio, not even a month ago and pretty much ended up kicking myself for it. Two days after buying the car, the check engine light came on.. I called the sales office and they said 'don't worry, it's actually a common thing and usually means nothing'. I took it to their service department anyways and they discovered that my car is missing it's purge valve? Ok, doesn't sound too bad to me, I waited a week and had the part installed today. Here's the kicker..now they're saying that there's this HOLE in my freaking GAS TANK (wtf?!!) and I 'have leakage in the evaporative system.' ok.. to me, this sounds WAY serious and I am one PISSED off chick! This is what my luck usually looks like... :(

Here is where the advice is needed. Oregon does have a lemon law, it is 4 mechanical visits for the same problem and/or 30 days inoperable. I'm pissed because it has taken 3 visits as of yet to figure this problem out and will take a fourth scheduled for 2 weeks from now to 'fix it'. (Why do I have a bad feeling that they'll find more wrong..) Should I let this slide and let them fix it and forgive and forget (btw, Kia has this nifty 5 year/ 60,000 mile warrenty thing going on, so at least I don't have to pay.) or should I go back to the dealership and get all pissy and tell them to give me my Blazer (or the 3 g's they traded it for) and the $1,000.00 down?
I'm not very good at playing hardball to get what I want, but I think it's the fairest deal.

Help? *on knees begging* Please? Advice?

I am not a lawyer and have no real legal advice, this is more personal

I'd march in there and as loudly as possible (on a busy day) tell them that this is their one chance to take this piece of shit off your hands and give you back your other car. And if they show the slightest signs of not taking you seriously, tell them that you are going to hire the skankiest hustler lawyer you possibly can and collect not only for your car but pain and suffering for having to deal with you assholes. (Unfortunatly having a man with you would cause then to take you more seriously) The trouble is once you've made a threat like that, you have to follow through or else you'll never have their respect or their help with your car.

Why keep it what's to say what else will go wrong? Do you want to take a chance on getting a long ways from home and having the car quit on you? Go talk to a lawyer most won't charge for the 1st visit when going to find out if you have a case or not.

I am sure you have but, keep all the copies of receipts, paperwork of what's been done and try to remember who you have talked to, times, about what and jot it all down.

Don't let it continue; dump that car ASAP.

If it helps, think of a guy you know who looks intimidating, and ask him to go with you when you deal with this. He doesn't have to say anything, but it will be helpful if they think you aren't alone.

I've given a lot of thought to a Rent-A-Hulk service for women.

I don't know about all that. I would rather deal with the biggest, meanest, sum-bitch of a man that you can find, than face a pissed-off woman on a "MISSION".
 
Oh man, my nightmare revisited!

Ya'll had to bring this up to the top? Lol. Ok, here's the scoop.

I've had the car since I made the first post. In that time, I have been to the mechanic 6 times. They have replaced the computer system twice, a purge valve in the gas tank, the cellinoid cannister (sp?), they have repaired a HOLE in the GAS TANK!, and did something to my catalytic converter. P.S. did I mention this despicable automoBILE is a 200-freaking-1?!

It was doing fine, but 2 days ago I smelled rotten eggs again and this time it was coming through the heating vents and I vomited. I AM PISSED!

All may be well though. I researched Oregons Lemon Law and it requires 3 documented visits (I have 2 certified documents) and I need to send a certified letter to KIA basically stating my sob story.. then they have to either give me a new car (SCREW KIA) or they have to give me the value. Shit, I'd be happy with the $4K I put down.

I'm going to waltz into the dealership and get all PMS-y on their asses. I don't feel safe in this car- 1. I have little kiddies to think about and 2. if I wanted to deal with this vehicle drama, I would've kept my '85 Blazer. I shouldn't have to put all this time or effort into this. I'm going to tell them my catalytic converter has literally made me ill, make my appointment for yet ANOTHER visit, and just dance away from the mechanic singing 'neener neener neener'...

Act immediately

Your car is considered UNSAFE by a number of legal standards. You don't need the lemon law to force action on the part of the dealer. You can call the Consumer Products Safety Commission (federal) or a state agency to require that the deal be unrolled and you awarded ALL costs PLUS the full retail value of your tradein. This INCLUDES lost pay, babysitting costs, the measurable value of ANY expenditure or inconvenience caused by the problems with the car.

If you confront the dealer with this demand, do so in writing with a registered letter to the OWNER of the dealership and certified copies to the general manager.

You will hear from their lawyer in 24 hours or less.

If they do not make immediate offes to resolve the problem, instantly call the Trial Lawyers association in Portland and get a referral to a good attorney. You can sue them in a hearbeat for treble damages and the lawyer will take the case on a contingency fee.
 
I think all of the advice people have given is valid. A new car should not have so many problems from the "get go" and I am shocked and amazed that the dealer has not already made an offer to do something. Just remember that you MUST follow through with anything or any action you take, otherwise you will be perceived as bluffing by the dealer. I think I would try a congenial matter of fact letter to the owner of the dealership and copy your BBB with the letter. See what kind of action that gets you. Also keep in mind to mention that at this point you have NOT consulted an attorney about the matter but that you will should things not be dealt with accordingly. Good Luck and Keep us all posted.
