A former U.S. Justice Department’s analysis of this year’s ‘religious liberty’ bill

Last year, Georgia Equality put former attorney general Michael Bowers on retainer and sat him in front of a legislative committee, where he denounced SB 129, a “religious liberty” bill authored by state Sen. Josh McKoon, R-Columbus.

This year, the LGBT advocacy group has hired Joe Whitley, a former federal prosecutor and U.S. Department of Justice official under the Reagan and George W. Bush administrations, to examine the two facets of HB 757, this year’s religious liberty vehicle.

Absent a committee hearing, we’re told that the document below has been handed to Gov. Nathan Deal and House Speaker David Ralston.

HB757 provides legal protection to individuals and corporations that discriminate against LGBT people and same-sex couples across the state, including the Ku Klux Klan.

This license to discriminate bill passed easily Friday, by a vote of 38-14. And this week, it goes to the House, where an earlier version of the measure sailed through. And even though there’s been no official declaration by the Republican governor, it’s likely Nathan Deal will sign it into law.


HB 757 would allow faith-based organizations and individuals to opt out of serving couples – gay or straight – if they cite a sincerely held religious belief or moral conviction regarding marriage. One proposal making the rounds would more strictly tailor the definition of a faith-based organization to exclude private organizations and businesses.

Lt. Gov. Casey Cagle presided over a Senate that voted 38-14 to approve an anti-gay bill that hijacked the harmless Pastor Protection Act from Rep. Kevin Tanner by tacking on all that is bad from Sen. Greg Kirk's First Amendment Defense Act.

A giddy Cagle couldn't contain himself on Facebook. That's where he expressed victory over "radical Atheist groups."
