This is a query prompted by a story I just read. I have seen several areas where authors can invite comments or discussions about their own stories, but none where readers can pipe up on their own.

If this is the wrong place for this query, I hope somebody would point me in the right direction!

The story is the first part of "Castaway," by "rnebular:" https://www.literotica.com/s/castaway-ch-01 This query has spoilers -- so if you don't want spoilers then by all means read the story first!!

This is a first-person past-tense story, told by James. In this story, James is married to Caitlin; Cyrus is his business partner and the first thing James tells us about Cyrus is that "he is an asshole." But, he adds, this makes Cyrus a very effective business partner. It looks like James mostly handles operations, while Cyrus mostly handles contracts and customers.

Caitlin, of course, is extremely attractive -- lucky James! As the story begins, James has been working very long hours and Caitlin has been feeling more and more neglected.

In the closing, very surprising scene of this first chapter ...

(spoiler space)

... James discovers that Cyrus has been doing Bad Things behind his back.

1. Cyrus has persuaded Caitlin that James is cheating on her. Cyrus went so far as to Photoshop James's face into some photos, to make them look as if James had been photographed having sex with various women. And ...

2. This made Caitlin angry at James that she agreed to have revenge-sex with Cyrus.

The story goes on from here, of course. But this is enough for my query. The nub of my query is this:

Once James and Caitlin find out what Cyrus has done to them, what can they do about it?

Let's set aside thoughts of personal revenge, even though the character "Cyrus" is created to be the kind of villain you would love to hate. Let's think about lawful, legal options.

Specifically, I would like to think about "the law." Could James and Caitlin use "the law" to get-even with Cyrus?

Oh, and I Am Not A Lawyer.

Now then -- Cyrus was able to persuade Caitlin to have sex with him, by telling her lies about James. Could this mean that the consent-for-sex that Cyrus got from Caitlin ... was as phony as his statements about James? Could a prosecutor get any traction by charging Cyrus with rape?

Another thought -- clearly, Cyrus defrauded them. He did not steal money from them, but I think we would agree that he caused them to suffer loss or harm, through deliberate deception. "Suffered loss or harm" ... isn't that a phrase that makes lawyers salivate at the thought of a lawsuit? Could James and Caitlin sue Cyrus, for having defrauded them?

If they sue him, in a civil suit, would they have to ask the court to impose damages on him. If so, would they have to assign a money value to those damages, or would they be able to request "damages" that don't have a monetary value?

I will close by saying that I do not expect this discussion to second-guess or restrain rnebular's creativity. When the story "goes on from here," it goes in a direction that makes all these questions kinda moot. Other factors enter in, and James & Caitlin will have other options than these ones, which are focused strictly on Cyrus's lies and deceit.

I just wonder. Could James and Caitlin get any help from the courts, about Cyrus's lies and deceit?

....

That would be the Story Feedback Forum. It's not exactly the New York Times Review of Books, but it's the best you'll get for a free forum.
