City cracks down on Ben Street

Erotic dancing simulated sex acts, complaint alleges

The operators of a Toccoa bar and grill will appear Monday evening before city commissioners to defend their alcoholic beverage license.

"They couldn't shut us down before, so now they're trying this," said Tammy Marsteller, who with husband David operates Ben Street Bar and Grill located at 111 West Curahee St. "I'm going to get my lawyer."

Mrs. Marsteller's ire stems from a document that was served to her husband on Wednesday.

According to the summons, which was served by Lt. Butch Newkirk of the Toccoa Police Department, patrons of Ben Street have violated the Official Code of Georgia Annotated and the Marstellers are in violation of two city ordinances.

The summons, which was signed by Toccoa Chief of Police Jackie Whitmire, states that on June 3 or June 4, 2005, "certain female persons engaged in prohibited conduct" such as the "simulation of sexual intercourse and displaying a portion of the cleft of the buttocks."
