Appeals court orders judge to dismiss Flynn charges

A federal appeals court on Wednesday ordered a judge to grant the Department of Justice's (DOJ) unusual move to drop charges against former national security adviser Michael Flynn.

A three-judge panel on the D.C. Circuit Court of Appeals approved Flynn's petition to intervene in the case after a district court judge had tapped an outside counsel to argue against the DOJ's move.

The panel ruled 2-1, with two Republican-appointed judges carrying the majority, that U.S. District Court Judge Emmet Sullivan overstepped his authority in second-guessing the prosecutors' decision.

"In this case, the district court’s actions will result in specific harms to the exercise of the Executive Branch’s exclusive prosecutorial power," Judge Neomi Rao, who was appointed to the circuit court by President Trump, wrote in the majority opinion.

The existing case law was presented in Flynn's motion, and addressed here ad nauseam. The court ruled on the law which had nothing to do with Flynn's coerced plea.

Most will hide from their pontificating about how Sullivan was anything but batshit crazy and their fantasies that Sullivan could act as Judge, investigator, and prosecutor and convict Flynn, much less all the other people they imagined this non-existent avenue to get anyone associated with Trump ensnared.

They were talking of Barr being sanctioned, disbarred, and jailed for reversing a clear-cut case of prosecutorial misconduct.

So in other words if it had been a Democrat majority they would have rubber stamped the politically motivated persecution of an opponent of the Party.

Once Democrats become undefeatable due to the orchestrated demographic change, they have every intention of imprisoning or killing anyone they consider an opponent (or in Flynn's case a traitor to the Party).

Then even after the opponent is dead, his or her memory will continue to be attacked and demonized and any legacy or positive contribution to society will be erased or desecrated. They are STILL persecuting poor Mrs. Schott to this day for example.

They are literally sick, like the mobs that kick and burn statues after they have torn them down. And the majority of brainwashed sheep slumber on occasionally snoring their tacit approval of the whole grotesque circus.

To reiterate, they want anyone who disagrees with them, particularly anyone who dares to publicly challenge them censored, depersoned, blacklisted, imprisoned, tortured, killed, then finally their memory desecrated and their body mutilated all the while calling themselves "virtuous" and "seekers of justice."

To paraphrase an infamous cable TV commentator, "this is our country now."

Gleeson sounded like any run-of-the-mill TDS sufferer here. Spouting the same breathless theories and Sullivan got caught up in the nonsense. The apparent enmity towards Flynn by Sullivan, when Flynn who has far as anything I have read did nothing to provoke that was odd.

Early on everyone had high hopes for Sullivan because he was the very judge who didn't like the prosecutorial misconduct in some other cases.

He has be cloud his reputation which was actually pretty good before this. Maybe he's slipping into Joe Bidenville. Never go full Joe Biden.

There are 17 judges on the full court, even if we were to see an en banc decision, I'd say the result would be the same as a big part of Flynn's defense is the Appeals Court own case law.

He did kick the crap out of the DOJ in the Ted Sevens case. Robert Barnes, of Barnes Law, a top litigator in the federal court system, has some harsh criticism of Sullivan and his legal acumen in past cases. If so, when did he have them and does this have something to do with searching his texts?

If not, why not?

It's my understanding that Mueller is a subject of Durham's investigation. He knew the day he took the job there was no case for Russian Collusion.
