Federal Judge Slaps Obama Down

Yay Judicial Activism!

It's only an "activist judge" when he disagrees with their decision.

Regardless, this will be overturned. The Supreme Court and Congress have said federal officials can set priorities in enforcing immigration laws. Past U.S. Supreme Court decisions have granted immigration officials broad discretion on deportation matters.
 
It's just an injunction pending the trial. Not dispositive of anything other than a Texas judge wanting his name in the paper.

Aside from common sense and an elementary understanding of the Constitution, the best argument against his action, is his own 22 admissions that he has no such authority, UD would now have us believe that Democrat promotion of Obama's alleged Harvard constitutional law professorship has no meaning in this case.

The "numbers" don't matter, either the executive has the authority to set priorities in enforcement or it doesn't. Unless of course you can point out where exactly any limit was put on the enforcement of immigration law. Just because you say so means nothing.

The USSC and Congress have both stated that it is within the authority of the executive branch in it's role of enforcing the law to set enforcement priorities. If the President decides that it's more important to go after illegal immigrants who are also violent criminals instead of the undocumented lawn care worker trying to provide for his family, then that's his prerogative. The judge in question can say whatever he wants, if the administration fights it, and it will, his decision will be vacated by a higher judicial authority.

Of course, Congress could just get off it's collective ass and reform our immigration law and make the entire point moot. But the House republicans are too busy at war with the Senate GOP to accomplish anything of substance.

Where were you when W was quietly issuing signing statements stating that he would not enforce laws that he personally believed violated his constitutional authority according to the unitary executive theory?

Congress has had years, decades to work on the immigration issue. They have done nothing. If congress is unwilling or unable to do its job then someone has to.

Bush lied and used the pussiness of those that would have spoken against invading Iraq against them. They knew it would have been political suicide.. So blame them for being spineless..but bush should have been tried... Along with Cheney, rumsfeld, ashcroft.. Etc
