CHARLOTTE, N.C. -- A registered sex offender with more than 30 previous arrests was given a $250,000 bond on charges of rape and kidnapping during his first appearance in court Thursday. Marcus Kennedy, 28, is accused of sexually assaulting a 12-year-old girl after she got of a Charlotte Area Transit System bus near her school bus stop in north Charlotte early Wednesday.
Many people are now asking why a man with a 12-year-long history with police was not behind bars.“I’m looking at this court system. What are they doing? His record's long and we just keep letting perpetrators out,” said Charlotte resident Barbara Grubbs.
A number of people told Eyewitness News on Thursday they’re questioning why Kennedy was on the streets, but a close look at his record reveals part of the answer.First, of his 39 previous criminal charges, 20 were dismissed by prosecutors, and in the 16 cases where he was found guilty, most were misdemeanors or low-level felonies that carried minimal jail time.
But court records also show evidence of more serious problems in Kennedy’s past. In 2001, Kennedy was charged with rape and later pleaded guilty to the lesser crime of taking indecent liberties with a child.When Kennedy was later sent to prison for failing to register as a sex offender, a mental health evaluation revealed he suffered from mental health problems and substance abuse, and he was prescribed a medication typically used to treat psychosis.
Kennedy spent more than a year behind bars. After his release two and a half years ago, he was arrested 16 more times, but spent just a total of 37 days in jail.Thursday, Mecklenburg County District Attorney Peter Gilchrist said he's prohibited from commenting on a pending case, but admitted "(The county has) been struggling with the issue of repeat offenders for some time. Some of them get in, get out, and we see them again."Grubbs said the thought is not comforting.“I'm sure that other people besides him are out there, and they're predators,” she said.Kennedy’s next court date, a bond hearing, was set for Oct. 20. He will have a probable cause hearing on Oct. 27.
Community Outraged By Child’s Rape Near Bus Stop
Neighbors said they found a 12-year-old pinned to the ground by a sex offender in some matted down brush in a wooded part of north Charlotte on Wednesday morning.
Amanda Seymour said she heard the girl scream and ran to help. Now, the outrage is still bubbling inside her."I hope we all get to go to trial. If we have to, I hope we all get to go to show the judge this man needs to be locked up for life," she said.Marcus Kennedy is charged with kidnapping and sexually assaulting the child.
The lead detective in the case, Detective Major Kay, said Kennedy was on a Charlotte Area Transit System bus with the girl before the attack.Police are looking at surveillance video from onboard the bus to see if there was any interaction between the two.Charlotte-Mecklenburg Police Department Chief Rodney Monroe spoke at a faith luncheon in Dilworth early Thursday, but he said the crime in north Charlotte was still fresh in his mind.
"You know, I can classify him no less than a monster. And that's what he is. I mean, you're going to take advantage of a 12-year-old kid on her way to school, there should be no mercy," he said.Kay said the child and her mother are getting counseling. Meanwhile, neighbors said they are growing more upset. "I have a granddaughter, and it would just tear me apart if something like that happened to her, you know," said Molly Neal.
