Apparently, he gave up ISIS' chemical weapons program. Wait. Was he arrested? Was he informed of his rights? Did he have access to a lawyer? How did they get him to give up this intel? What do they do with him now?

If he's not an American citizen, none of this applies. Also, has ISIS been accepted by the United States as a constituted belligerent army? (I sort of doubt it). If not, the Geneva Convention doesn't apply either. The convention was established before guerrilla forces were recognized. Where to stuff him isn't as big a problem as most think.
 
What are you referencing this to?

I don't have a legal problem with Gitmo as long as these are guerrilla forces. I have a problem with hashing it all over in public. In today's military scenarios, WWII rules of engagement are hopelessly outdated.

Waterboarding, though, is beyond the pale, and, as McCain has said, resorting to it destroys any indignation (and moral justification for preemptive response) we can have when others do it on our people.

But the Constitution applies to everyone, not just citizens.
