Horrific case, and such a fuck-up and a complex ethical dilemma, indeed.
1.On one hand they are right to consider charges:
- She was old enough to know the risks - no excuse for stupidity when it comes to messing with another living being. She should have gone to an abortion clinic.
2.In the woman's defense : Were stigma and fear a factor?
- Were her parents very judgmental/even tyranical when it came to such issues?
- Or on a larger societal scale: Did the whole PP noise and stigma re abortion (from some R-wing political and religious figures) play a role in her reluctance to attend an abortion clinic?
24 weeks is outside the legal limit for an abortion. 24 weeks is the dead end of the 2nd trimester.
You're totally right, and I actually edited it after I posted (I realised I was unclear about what I meant) - see my prev. post.
Nevertheless:
1.In a nutshell, my personal opinion is that she's guilty and should be charged.
2.But I also wonder what led to her to carry such a horrific and stupid act.
Because, as a woman (plz don't start with the m/f thingy - it's irrelevant here) I just can't see that a woman would carry such an act, unless there were specific circumstances. And she doesn't look like a psychopath: those ones are good at covering their own tracks.
- misinformation?
Did she have a low IQ and didn't quite understand what she was carrying at week x was different from week 10, for example?
Or did she belong to an extremely fundamentalistic family or church who didn't make it possible for her to have such information?
- or what else was going on in her life that led her to carry such a horrible act?
Looks like an impulsive act, so what happened for her to lose her head and act in that way?
etc. etc.
3.In a nutshell, I think there's a bit more to the whole story than a straightforward 'psychopathic mom kills her baby' scenario.
ADDIT.
Have you ever come across such cases? You mentioned some forensic testimonies, at some point. What's your view of how things might have possibly unfolded?
I spent 20 years working with people, up close and personal. I've seen it all and nothing they do shocks or surprises me, I even expect most to be far worse than they act.
My best guess is this: The baby isn't her husband's child. They reconciled and he demanded she get rid of the baby. It was too late for a legal abortion so she filled the bath tub with water and went fishing with a clothes hanger. The scenario is common tho late term abortions aren't. Many husbands let the wives keep the babies.
Marjorie Kinnan Rawlings wrote a short story about it. Hubby goes to prison for murder and gets pardoned 2 years later. His wife has a new baby waiting for him.
Makes + + sense as one likely scenario, imo.
What's the name of MKR's short story? I might download it on ScribD.
