In his decision this week, Judge Robert Broadbelt III ruled that Clifford was entitled to legal fees, finding her the "prevailing party" under California law, despite the case having been dismissed.

Broadbelt also rejected an argument by Trump's attorneys that the President was not liable for the fees because he had not signed the NDA.

In his decision, Broadbelt wrote that since Trump had reimbursed Cohen for the $130,000 payment to Clifford, and since the Trump legal team had earlier argued that a defamation suit filed against the President by Clifford should be handled by an arbitrator per the NDA, the President was effectively a party to the agreement.
 
Be positive. A $40,000 contribution to this particular prostitute has at least reduced the court cases against Trump and his firm from 63 to 62. ;)
 
Instead of taking it as a business expense this time, maybe he should take it out of Melania's allowance.

Trump's attorneys will appeal and the ruling with be reversed because, under California law, there is no "prevailing party" when a matter is dismissed.

I personally think NDAs should be abolished. Courts are public and anything that goes through them should be public. That alone may reduce frivolous cases.

Settlement agreements are often included in the court file if there's something the court needs to have "continuing jurisdiction" over.

Often it's that the terms of the settlement requiring one party to make payments on the agreed upon settlement amount. Until that's paid in full, the court will have jurisdiction to reopen the litigation.

In such a case, the settlement agreement includes a clause where neither party admits guilt or fault and the settlement is being made to reduce the costs of litigation for the parties.

It's public, it's there in the file, and it means nothing.

Everything that goes through the courts needs to be public. Possible exceptions, youth adoption cases, witness or victim protection records.

NDA's never get to court files because the person subject to the NDA cannot comment on them except to say that they cannot comment.

I think what you want is to make NDA's illegal just so you can dig around to find dirt on those you don't like.

The problem is that NDA's serve a purpose and as a legally binding contract, your desire to pierce them violates that purpose and intrudes into the contractual agreement of other persons without need or lawful support.
