The LIT rule is against underage sex, including voyeurism. I'd split hairs and call mercenary rapine an act of violence, not sex. The young children witness a horrible assault -- they are not erotic voyeurs. If they're young enough, they won't recognize the sex, just the violence. AFAIK there's no LIT rule about kids witnessing violence.

Of course, you could play it safe and have the mercenary slaughter the kids before or after assaulting their mother. Or more likely, avoid explicit detail of the rape as seen by the kids. Don't describe penetration from their POV. Maybe just say they're horrified and terrified.

Lit is pretty strict about the under-18-no-sex rule. As Hypoxia noted, you can't have kids (i.e., characters under 18) involved in, party to, or witness to sexual acts. Even though this is an act of violence, it is a sexual act even if it isn't erotic, so I think having kids as witnesses would run afoul of the rule.

From my experience editing stories for authors that were flagged for "underage sexual relationship(s)", based on the scene you describe, what will happen first is your submission WILL be flagged and a message sent back giving you the basic 'canned' response from the automated software that decides such things. As the author, you can either change the story so it passes the automated checking software, or ask Laurel - who has the final say - to look at the particular situation and decide if the web site may end up receiving fines for publishing the story as is. I could be very wrong, but I doubt Laurel will take a chance on publishing anything that might risk the future of the site.

If I were the editor, I might produce a suggested method of writing the scene differently for the author, or recommend that they find another way to write the scene, that is, at least while publishing the story on Literotica is their goal.

It is a little hard to visualize an automated special purpose checker sophisticated enough to pick up all instances of underage violations, or other rules of the site.

For example I wrote a story that was rejected because I "advanced" the ages of well known teen age characters to detail an experience later in life. That bounced back due to a sort of esoteric codicil to the rule prohibiting that. But how would an automated checker have known that the characters I named were underage in the original literature?

OTOH I also had a story bounced early on because I had more than one speaker quoted in a paragraph, even though great writers occasionally violate that rule for effect at times. That seemed to me to be more an automated response. Using a standard grammar editor would have caught that and maybe that is done first.

I think I posed a similar question some time back, re: a classic SciFi story of a few generations back. A girl was struck by polarized lightning or whatever when she was ten. That was a few thousand years ago. Since then, she's lived as a child or child-bride or child-whore in many situations. She is very old story-wise, but appears pre-pubescent.

I was told that this would be rejected at LIT. That may be because she's HUMAN, even if magically transformed. Rules for orcs, elves, kobolds etc are a bit different here. Ask Laurel. Or write it, submit it, and see what happens.
