Brandon Teena Killer Denied DNA Appeal

(Lincoln, Nebraska) The Nebraska Supreme Court has turned down an appeal for DNA testing by the man convicted of murdering transgendered teen Brandon Teena.
John Lotter, on death row for the killing, claimed that DNA evidence would prove his innocence.
The court ruled that DNA results could not produce evidence that he was wrongly convicted or sentenced._ Lotter claims that his accomplice, Marvin Nissen, actually murdered Teena and two witnesses in a farmhouse outside Humboldt on New Year's Eve 1993.
The murder inspired the critically acclaimed 1999 movie ``Boys Don't Cry.''_
Teena, a pre-operative transgender male who was born with female organs._ The 21 year old_ lived as a man but_ when Lotter and Nissen discovered he was biologically female, Teena was raped and then shot to death.
The men also killed Lisa Lambert, 24, and Philip DeVine, 22, who had witnessed Teena's killing._
Nissen, in a deal with prosecutors, testified against Lotter and was sentenced to life in prison. Lotter received three death sentences and awaits execution in Nebraska's electric chair.
It is the second appeal Lotter has lost._ In July the state Supreme Court rejected an appeal based on a 2002 U.S. Supreme Court ruling that said juries and not judges should decide a killer's fate when the death penalty is sought. The court said that the US Supreme Court ruling was not retroactive
