And you can't post her pics here in the forum without getting the mod and/or owner involved. There's a soft rule about the permission and whatnot. (And, yes, it is easy to lie. :rolleyes: )

Also my understanding is that a photograph belongs to the photographer, not subject. A person in possession of the original photograph, unless otherwise stipulated in a contract, is the owner. As a digital artist, I know there are ways to find a digital image's history.
My other understanding is that the law is for arguing actual cases, not hypothetical ones. So far, OP hasn't suggested anything untoward.
I'm just here to write and share ideas though, not win a case.

By default the photographer does own the copyright to the photo. But that alone doesn't always give them the legal right to publish it; depending on the details (jurisdiction, context of the photo) they may also need the permission of the subject.

Also many times there are additional stipulations if the picture is posted on any type of erotic content and this is an erotica site and the pic would be used as 'motivation' for a sex story.
 
No real names locations or addresses will be used. And definitely not trying to do anything illegal

Having fun yet scotty :rolleyes: This is what happens when people have too much time on their hands ... they make up a problem that wasn't even there in the first place. And to boot, anyone who might be able to write the story for you shouldn't need a photo in the first place. You should be involved in the development and shaping of the work anyway...because it's your story. This is supposed to fun and a special thing for you and your wife, I hope you don't let this little spat discourage you.

Only if he posts his idea. If he asks for PMs or other forms of private communication he's written a personal ad for private chat.

True. I hadn't thought of that. My post assumed that it would end up as a story for publication, not private use. (But if I were fishing for an author, "Story Ideas" might be a place to drop my hook.)
