Ford and Kavanaugh alike were denied any semblance of due process - a thorough and impartial investigation of sexual assault allegations that involves the full discovery of facts and witness testimony.

Brett Kavanaugh joins the Supreme Court as damaged goods, dogged by questions about his integrity that he may never be able to outrun — casting a pall over the institution for a long time to come, high court experts said.

"I don't think he'll ever be able to disassociate himself from what just happened," said Benjamin Barton, a professor at the University of Tennessee College of Law. "For Kavanaugh, this is a first-paragraph-of-his-obituary type of situation. He's going to be known for this and stuck with this for his career."

Barton added, "Every single case that he is on, people will say, 'Hmm, I wonder what Kavanaugh decided for this?' When we have a whole string of 5-4 decisions with Kavanaugh on there, it will make it seem like a partisan body, which is terrible for the Supreme Court and bad for the country."
So let's assume that Ford's accusations were false (an unlikely scenario, at best)

if due process had occurred here, Kavanaugh's name would be cleared, just like Brian Banks and the Duke Lacrosse team, and he could be out from under this cloud.

Ironically, "it's a scary time for young men" has more hope of becoming a true statement when sexual assault accusations happen and there is no due process. Men's Rights activists know this quite well. The problem is that in this case due process was denied to Ford - and, as a direct result, denied to Kavanaugh. MRAs and their MAGA allies have decided that they favored denying due process to Ford - but they think that Kavanaugh cannot be negatively affected by that. They're wrong. You cannot deny due process to a woman who accuses, and fully exonerate the accused man. You can't have it both ways.

Due process, when carried out in a thorough and impartial manner, brings the guilty to justice and it also carries the innocent to freedom.
