Are Celeb Disclaimers Necessary?

Hi,

The next chapter of my story involves characters from a particular television show. I've kept my story ("Angels, Demons and Alex") in the sci-fi/fantasy category because that seems the most appropriate place. The TV spot is mainly just a brief tangent, and not a full incorporation of characters... it in fact references the show as a show. I'm not adopting/stealing the characters or anything.

Do I need to put in the whole disclaimer from the Celeb category? Is that something Literotica generally expects to see?

You would need to ask the management about that but, IMHO, you would need no disclaimer if the characters are discussing an actual TV show as part of the dialogue. Authors do not put in the disclaimer. Literotica does that as part of the posting of a story to the celeb category.
 
The answer might be different if it is taken out of the American context. It is much easier to sue for defamation under English law than in the USA. Recently a few Americans have done just that; they have sued other Americans for publishing defamatory content in England (by posting it on the internet).

It surprises me slightly that Literotica does not put a disclaimer on all its stories to cut off the opportunity litgants may have to go jurisdiction hunting.
 
If your characters are discussing the show, if your character has a wet dream about one of the show's characters-- or even about one of the actors-- You are fine. You are placing them into the context of everyday life. You can describe the wet dream to your hearts content, in fact.

IF your story incorporated the characters as characters in your story, then you've crossed the line into fanfic. Which is still legal.
 
To elaborate on what's already been said: If your story had an actual celebrity in the story, then it would get posted in the Celebrities category with the automatic disclaimer by Literotica.

I've referenced movies and TV shows in my stories in the past with no problems. I've even used song titles as story ideas (as have many others.)

With what you're describing, you should be fine without any type of disclaimer.
