Apple iPad in trouble again?

The new iPad, promoted as 4G here in Australia, doesn't actually work on the 4G network as standard.
The Australian Competition and Consumer Commission has taken Apple to court over it.

I have the Samsung tablet.
What the telcos fail to disclose, is that currently 4G only operates in limited areas.
My 3G works everywhere.
