A federal judge on Thursday imposed a preliminary injunction on the Biden administration’s rules for Immigration and Customs Enforcement (ICE) officers that significantly narrowed the categories of illegal immigrants being targeted for arrest and deportation – a ruling that marks the latest legal blow to the Biden administration's immigration policies.

Judge Drew Tipton ruled that the policy was in violation of congressional mandates, and that Louisiana and Texas, which filed the lawsuit, were likely to succeed in their claim that the policy violated the Administrative Procedures Act (APA.)

The Biden administration issued the guidance in February, limiting agents to focusing on three categories of immigrants: those who pose a threat to national security; those who have crossed the border since Nov. 1, and those who committed "aggravated felonies." It followed on from Jan 20 guidance issued by the Department of Homeland Security.

Officials said the guidance does not explicitly prevent anyone from being arrested or deported. Instead, it directs resources at certain targets. However, field officers seeking to arrest someone outside of those three categories needed approval from their chain of command.

"By focusing our limited resources on cases that present threats to national security, border security and public safety, our agency will more ably and effectively execute its law enforcement mission," ICE acting Director Tae Johnson said in a statement. "Like every law enforcement agency at the local, state and federal level, we must prioritize our efforts to achieve the greatest security and safety impact."

“Tipton has fully blocked the Biden administration from enforcing the February 18 priorities memorandum,” Aaron Reichlin-Melnick, policy counsel at the American Immigration Council, noted via Twitter. “This leaves ICE with, as far as I can tell, NO priorities at all.”

“Tipton also gives himself extraordinary power for a judge to almost single-handedly oversee the entire ICE apparatus, demanding to know every single case around the country in which an immigrant isn’t detained or can’t be removed with 90 days, including their addresses,” Reichlin-Melnick added. “This is an unprecedented and outrageous decision that threatens to force the Biden administration to lock up many immigrants who are long-time members of their community who the government does not want to detain and deport. This is a dangerous precedent to set.”

“Imagine being a biglaw [Federalist Society] guy that Trump made a judge one year ago, waking up one morning and deciding to make yourself the emperor of United States immigration policy,” added Third Circuit-focused appellate attorney Matthew Stiegler.

The order also dismantles long-held understandings of executive branch authority over the Department of Homeland Security.

“Judge Tipton becomes the first judge ever to declare that DHS may not–even in the exercise of prosecutorial discretion–release someone from detention during the removal period,” Reichlin-Melnick tweeted. “This would overturn a century of precedent giving the Executive clear discretion over these decisions.”

“Judicial activism at its worst,” the attorney added.

WASHINGTON (AP) — The Supreme Court is temporarily halting a judge’s order that would have forced the government to reinstate a Trump administration policy forcing thousands to wait in Mexico while seeking asylum in the U.S.

Justice Samuel Alito issued the temporary stay late Friday night. It will remain in effect until Tuesday night so the high court can consider filings in the case.

A federal judge in Texas had previously ordered that the program, informally known as “Remain in Mexico,” be reinstated Saturday. The Biden administration appealed to the 5th U.S. Circuit Appeal in New Orleans and asked for a delay in re-implementing the program, pending appeal, but that was denied Thursday.
