My former landlord took me to court today. It's been a long, drawn-out piece of bullshit, and I was nervous as hell.

Well, he didn't show up! The court clerk even read the roster of court cases twice, thinking that many people would get there late due to inclement weather. Well, my former landlord didn't answer when the case was called, so it was dismissed! Yay for me!

Does anyone know if he can try to take me to court again, even though the case was dismissed?

It was likely dismissed without prejudice, which means he can sue again.

It's a long story...

I lived in a co-op building, and my old landlord owned the apartment that my roomate and I lived in. He was a real fuckhead- he entered the apartment without permission before the lease was up, moved my stuff while I was in the process of moving, and some of my clothes (which were in huge bags) were missing as a result. I took him to court over it, and won.

He then served me with papers, claiming that I (not my roomate and I, just me), caused $6000 in property damage, and also that I bounced a check to him (I didnt; my old roomate did). His accusations were totally unfounded, so I knew that there was a good chance that he wouldn't win, but I worry a lot, and I was sweating it. I'm glad he didn't show up today.

Why would it be dismissed without prejudice? HE was the one taking ME to court.

Because the case was not decided on the merits. It was decided because he failed to prosecute his case. It may have been dismissed with prejudice, though. You will have to check the final entry.

Ok, dumb question: how do I do that? Go to the courthouse and look up the file?

If he had shown and she hadn't, he would have automatically won.
That is wonderful to hear, although the laws might be different in NY.

That's fantastic news! I know this has been going on for a long time. Finally some relief! I think the asshole finally got it, that he didn't have any real merit whatsoever, to come after you, and pursue it any further in court.
 
Thanks everyone. I didn't realize how muchi had been stressing it until afterwards.

The one thing that does suck, though, is that I had to take off of work to go. This is right after I got docked 3 days because I had strep throat. My employers are so empathetic- can't you tell?
