They're saying the legislation was a "bill of attainder" as a basis for their legal action. We'll see how far this goes.

It's hard to argue that the legislation passed wasn't directly intended to punish one particular entity, namely ACORN. Mostly because that's exactly what it was.

The Defund Acorn Act is likely to be ruled unconstitutional, the Congressional Research Service says in a report obtained by the Huffington Post, responding to questions from Reps. John Conyers (D-Mich.) and Barney Frank (D-Mass.).

The Constitution forbids "bills of attainder" written to punish a specific individual or group of people. The independent research body determined that the bill intended to defund the community organizing group ACORN "would appear to meet a per se criteria for specificity."

I think what constitutes "punishment" and "judgment" in regard to an alleged Bill Of Attainder is a bit more complex than you saying it. It seems to me that Congress has every right to withdraw funding from an organization engaged in illegal activity, to prevent the design of a felony, or for the purpose of curtailing illegal activity promoted and revealed by the admissions or testimony of it's own officers and employees.
