a question about rights

I recently had some poems accepted for both print and web journals. If I wanted to submit the poems that were accepted for print (and vice-versa) to web journals would I have to offer reprint rights or simply say that are previously published?

I'm a little confused on this :confused:
 
Read the fine print. For most places you grant them the right to print your poetry once, sometimes they also have the second rights for a compilation. Often the first publisher wants credit, and the second would want to know if published elsewhere.
Again.
Read the fine print on the submission page, YOU should retain all other rights, unless of course large sums of money and lawyers are involved.

They usually ask if your poem is published elsewhere and ask that it be removed from sites, and of course list previous publications. It will be stated in the contract or submission form the guidelines for publishing with them.

Eek. You guys are right. On the other hand, I'd like to protect my anonymity on the site. Hmmm. what to do? Might have to take off my previously published stuff. Orrr... Maybe first I'll chat up the editors and see what they say. If I recall there was no language around mention requirements, but I'll double check.

Guess I'll need to write more new stuff if I want anything up! =D (always a good thing, anyway.)
 
The best thing to do is to always write more stuff. Then you have lots from which to choose and also it's good for your soul. :)

But read submissions guidelines carefully! Most publishers (online and in print) have one-time publication rights, which means you cannot have your poem(s) published elsewhere while they are in your publisher's current issue. After that, you may reprint your work--ownership reverts to you. The publisher may also require that you mention their name in any reprint of the poem(s) (not all do). Also be aware that many publishers (especially print ones) do not want reprints for submissions; they want first-time rights to original material. Think carefully about where you want to submit what you believe are your best poems.

What I've outlined is standard for many publishers, but some do have additional requirements. I accepted an agreement to one place without carefully studying the submissions guidelines and now they own the rights to publish my poem beyond their journal when (and if) they decide to publish an anthology. And I can't publish it elsewhere in the meantime. That's a hard way to learn, so read those guidelines!

Congratulations!

If you had a poem published on-line, print journals will still consider that previously published and vice versa, regardless of the medium in which it appeared. Sometimes they mind, sometimes they do not, the best bet is to be upfront and honest when you submit. "Please consider the following poems for publication in your journal "Blah blah Quarterly" All are previously unpublished except for "A question about rights" which has appeared on the web-based journal, Black Magma.

I do not know anything about reprint rights. Sometimes places will request exclusive rights for a given amount of time, so that your poem appears exclusively on their site/journal for a given amount of time, generally while the issue is current.

Once I have had a poem published, I rarely send it out to other places, I think it is psychological, like I check one off my to do list. ? But I have done it without problem. I have seen the same poem from others published on many different sites. They always mention the first place it was published.

I have mixed feelings about literotica. Since there is no selection process for the poetry, I do not consider it published when my work is here. However, there are some journals that consider a poem previously published if it appears even on a bulliten board/blog.

I do not think I have ever seen "previously published at Three Penny Review" on any poems at lit. Many places request that you give them a mention. I am not so sure they can require it, although the second place to accept a poem would be able to require you include that in their journal.
 
goodness I am no expert, I have only been doing this for about 2 years and am still very much trying to figure things out myself. :)

yeah, Anna, I was thinking of it kinda as a blog here and didn't think to credit the other publications, but it's true they may not want mention here. and there is the anonymity thing. *shrugs* well maybe I'll just not mention anything. I'm sure it's not like they're gonna sue or something coz my silly poem was posted on a porno site by some anonymous person. haha.

right, they won't sue you :cool: but don't be surprised if you raise an eyebrow when someone recognizes your work from somewhere else-- it is a smaller world than you might think. I have recognized poems out there in the world that came from lit writers who actually used screen names that I did not even know were their original pseudonym that I knew them as.

gosh that makes no sense.

example, say I saw a poem posted by Barbara Smith on a site and I recognzed it as a poem written on lit by chicky_poo who I had not even known was also Lovely_LindaZ.

So I wrote Lovely_LindaZ (who I knew was Barbara Smith) to congratulate her, and also to make sure chicky_poo had not somehow gotten to her poem....to make sure the three were really one :)

And this happens, just so you know. Many poems here at lit have appeared on other people's blogs, sites, etc without permission, sometimes without credit given to the author at all. Maria has had a bunch of stuff ripped off.

At any rate, I always (try to) take my stuff off of lit when it is to be published elsewhere... for a number of reasons.... just to be sure. Some writers even remove their poems from the threads, but I have yet to do that.
