It’s ridiculous. Just execute the prick. Now they have to try him again in a new venue to get the death penalty to stick. The families need to be put through that again and the expense needs to be borne again. The fucker confessed, there is video of him commuting the crimes ... how does dragging this out give any meaning to justice being served?

First of all, they didn't "throw out" the death sentence. Instead, the remanded the case back to the trial court to have a different jury decide the penalty phase.

This is a typical effort that all death penalty inmates use to try and delay their execution. Right now, on average, it takes 20 1/2 years from sentencing to execution. The reason it takes so long is because of things like this.

Lastly, I seem to remember this board being sooooo vocal against the death penalty the last time this was discussed. Yet, here we are talk about Tsarnev not being executed because the courts didn't do their job and shitcan the guy asap.
 
Just abolish it entirely and stop all this kind of courtroom theatrics.

Trump has stood by and done next to nothing, or perhaps been wilfully tolerant of the 152,000 + who have died from COVID-19, yet people are not screaming for his trial, and perhaps execution....get your priorities straight down there cousins....
 
It should be stressed that the only thing that was tossed out here is the penalty, not the actual conviction, which was uncontroversial considering Tsarnaev didn't really contest his guilt.

You'll get a new penalty phase, where presumably the judge will do a better job making sure no one with a public history of saying "Hang the bastard" winds up on the jury.

BOSTON — In his first public appearance since he was captured hiding in a boat in a Boston suburb almost three months ago, Dzhokhar Tsarnaev, the surviving suspect in the Boston Marathon bombings, pleaded not guilty on Wednesday to 30 federal charges contained in a sweeping terrorism indictment.

With his left forearm in a cast or heavy bandage and with about three dozen victims and their family members looking on, Mr. Tsarnaev stood before a United States magistrate judge, Marianne B. Bowler, and said “not guilty” seven times as he was asked to enter a plea to different criminal counts covering his alleged role in killing three people and wounding more than 260 near the finish line of the race on April 15.

Most of the charges could mean the death penalty or life imprisonment if he is convicted. Mr. Tsarnaev has also been charged in the shooting death of a Massachusetts Institute of Technology police officer three nights after the bombings.
 
What should be stressed is he was found guilty and sentenced to death, legally. According to the law. With due process ... blah blah blah.

What should also be stressed is that those that do not like that there is a death penalty are subverting the system.

As a result the families of the dead and the victims will have to be put through this whole process again.

Not if the Jury has been shown to be biased.

There have been literally dozens of convictions overturned for a number of reasons. People that have been in prison for decades have been freed because it was determined they never did what they were accused of. Execution can't be undone. Even one exoneration is grounds to abolish the DP.

Meanwhile you've stated that you'd be good with Trump going to prison even though he hasn't ever been charged with a crime.
