Good News for Kyle Rittenhouse

The defense can call them arsonists too. Totally objective.

The whole point of the trial is to prove if they were victims or if the Rittenhouse acted in self defense. The probative value of the use of the word "victim" is substantially outweighed by the danger of unfair prejudice against Rittenhouse.
 
The whole trial-by-jury system is designed to give the upper hand to the defense, because letting a guilty party go free is by far the lesser evil than convicting an innocent person.

That's a bitter pill to swallow in light of how rarely it works out that way for defendants who aren't either white or extremely rich, but still...

It's doesn't work for people who aren't rich. The worst thing you can do is hire the public defender. If an attorney in private practice took on as many cases as a public defender or did half the things the public defender did, he would be disbarred.

From I'll I've read about this case, Rittenhouse is the one who came armed. The dead guys didn't. Where does self-defense enter into it?

Millions of people carry a gun every day. It's all about the mens rea. As a lawyer, you know that.

I know that a civilian who went armed to a political demonstration of that kind cannot have had any innocent mens rea.

I hope that Kyle is found innocent. I wish that whole event never happened, but from everything I have seen and heard, he was constantly retreating, constantly trying to get away while people chased after him, shot at him, threw things at him, hit him with skateboards and grabbing for his gun.

It's clearly a case of self defense, and the only reason there is even a trial is because the Left is appalled that anyone would dare to defend themselves against their brown shirts.

I think that sums it up.

He has a class A defense team and the local DA has a reputation of being a political moron. It's going to come down to jury selection and potential intimidation.
