Kavanaugh, being legally savvy, will know not to presume he only needs to worry about Sexual Offense in the Fourh Degree. Or to presume that the allegations his accuser has made so far would be the limit of the eventual case presented against him. He’s got Attempted Rape in the First Degree, Attempted Sexual Offense in the Second Degree, and Attempted Sexual Offense in the First Degree to worry about.

I believe those are felonies.

No, I am not assuming what the media has reported is true. If I did, I would be talking about what crimes Kavanaugh is guilty of, and I’m not. In the context of criminal charges, the state has the burden of proof, and Kavanaugh is presumed innocent.

And that’s why I said I needed to revise my opinion of the situation. This isn’t a mere matter of a job interview. His testimony before the Senate may in fact be entangled with Due Process issues, specifically the 5th Amendment.

Remember, that’s what I said first. And you disagreed with me, saying that he didn’t have to worry about criminal charges, and thus (by logical extension), there were no due process concerns and the Senate could require of him to answer any question and even presume the allegations are true if the Senate decided that was fair.
