We don't have as much leeway as we used to. We can't keep tabling these things and kicking them down the road. We have about 7.5 billion people, resources gobbled up faster than Ma Nature can restore them and we (pardon the expression) seem intent on shitting where we eat without regard for the consequences.

Paul is wrong in two major ways.

First of all, there is nothing routine about FISA warrants. According to this 2013 Mother Jones article:

the FISC has declined just 11 of the more than 33,900 surveillance requests made by the government in 33 years, the Wall Street Journal reported Sunday. That's a rate of .03 percent, which raises questions about just how much judicial oversight is actually being provided.

Nearly 34,000 surveillance requests is a lot of spying. But 33 years is also a long time. An average of 1,000 surveillance investigations per year in a country of over 300 million people is NOT "routine."

Secondly, and most importantly, the idea that either NSA or the FBI is "targeting foreigners for the purpose of" getting to Americans is fucking nuts! Or at least it is fucking nuts to believe it is happening routinely to thousands, hundreds or even a few dozen innocent Americans. Not to say it CAN'T happen. In fact, it might even be a small subset of that .03 percent of requests that the FISA court rejects.

Because the legal standard for issuing a FISA warrant
"requires the court find probable cause that the target of the surveillance be a "foreign power" or an "agent of a foreign power", and that the places at which surveillance is requested is used or will be used by that foreign power or its agent.[2][18] In addition, the court must find that the proposed surveillance meet certain "minimization requirements" for information pertaining to U.S. persons."

Edited to add: Judges who sit on the FISC are rotating federal judges. The fact that they reject so few of the government requests for surveillance warrants means one of two things: either they are a part of the surreptitious criminal conspiracy of spying on Americans excessively OR both they (and the government) are doing a reasonably good job of adhering to the legal standard of "probable cause."

Again, which of those two positions you tend to believe will depend on your level of government cynicism.

Oh, and one last thing everyone keeps forgetting about.
In order for the government to "target foreigners in order to listen to YOUR phone calls" it has to somehow know in advance of that call that you have been or are likely to be talking to the targeted foreigner. Until such time as the government makes that connection, all previous unrecorded calls between you and "the target" have disappeared into the ether. The government can only tape the foreigner's calls and hopes he contacts you at some point in the future.

It shouldn't take a rocket scientist to figure out that this is a horribly inefficient way to spy on YOU. Which is reason enough why it doesn't happen very often. :rolleyes::rolleyes:
