I think when he said, ''It was a poor reaction to the situation, but one that cannot go unpunished'' he ruled out it being justifiable. he's more making the case for it being understandable.
Yes, he said that. It was a throwaway line, a perfunctory nod towards "crime 'n punishment". You'll note, however, that the rest of his diatribe was a full-throated rationalization for the shooter's conduct.
"He was scared! He was terrified! Urban society has decayed to the point where those unGodly black folks and brown folks have destroyed all that we hold dear! Of course, his actions were wrong but he felt as if he had no choice but to shoot!"
