Breaking – State moves to charge Zimmerman with 3d Degree Murder based on Aggravated Child Abuse





As expected, the Judge in the George Zimmerman case ruled that in addition to Second Degree Murder, she will instruct the jury on the lesser included offense of Manslaughter, as required by Florida case law.

In a surprise move this morning, the prosecution asked the Judge to drop the Aggravated Assault charge and to instruct the jury on Third Degree Murder, which is murder in the course of committing a felony.

The felony the State wanted as the predicate was Aggravated Child Abuse (Jury Instruction) because Trayvon Martin was 17 at the time of the shooting.

According to Don West, the defense was not notified until 7:30 a.m. this morning.

This surprise is important because the defense did not have time to research the law, while the State presented numerous cases. Generally it is not a defense to child abuse that the perpetrator did not know the age of the victim. This is an unusual circumstance, however, where Zimmerman was punched in the nose and the “child” was on top punching him — to say that excessive use of force in defense of an attack by a “child” is child abuse certainly requires some time to research and argue. I don’t know the answer to that legal question, but the court should give the defense time to research and argue it. (Update 11:35 a.m. — Judge just indicated she will give defense time to research, but didn’t indicate how long until 1 p.m.)

The city must be worried about being called racists because they claim it’s just a training exercise while the police officers say it’s aimed at the Zimmermna trial.


MIAMI (CBS4) – Wednesday, around high noon, dozens of Miami Police officers lined up for riot training.

Armed with batons and horses, officers ran through various formations preparing for the worst.

“It’s a mandatory training. All these officers are given this equipment and it’s in the event we have civil unrest at any given moment our officers are ready on a minute’s notice,” Miami Police spokesman Freddie Cruz said.

Ironic that is happening the same week a verdict in the controversial George Zimmerman trial could come down, a verdict that could incite civil unrest.

“This is just purely coincidence and it is mandatory training we have to do every year.” Cruz reassured.

Miami’s police union believes almost too coincidental.

“It’s very coincidental that it’s falling at this time.” Javier Ortiz with the Fraternal Order of Police said.

The union president said he hadn’t heard about the training until a few weeks ago.

“We haven’t had the training since 2011 so I don’t know if it really considered routine.”

The training, happening for weeks, will wrap up this week.

“There has been some talk among the officers that we believe that this training has to do with the fact that there might be some type of civil unrest, but we are hoping that that doesn’t happen,” Ortiz said.

Around here we have cop killings on hold cuz the state is so timid about trying the blacks who are charged. One has been defrosting for 3 years without a trial.

I would say race relations have definitely changed since obama became president. He has done more to ruin them than any other person sitting in the WH. I think there were still many problems along race lines, but I also think, before he became potus, things were moving in the right direction.

Obama has made sure to reverse all of that. I think the divide is greater now than it has been in many many years....and this trial is a perfect example.

Many non-liberals agree with you and have voiced the same concerns over the past few years. People who never had a racist thought in mind have since come to resent the hysteria surrounding the "racist" accusations and the unfairness of many issues concerning this DOJ under the direction of this administration.

The key to good racial relations has always been equality and balance. More than ever before, the fairness of governmental influence has tilted severely toward promoting division, rather than balance.

Breaking: Charge on Murder 3/Child Abuse is denied by Judge Nelson

This morning the Court in Florida v. Zimmerman conducted a hearing to finalize the instructions that will guide the jury on arriving at a verdict. While some of the instructions were long-expected and raised little debate, others could only be described as a preposterous effort of the State prosecutors to ambush the defendant, George Zimmerman, with the effect of once again denying Zimmerman his Constitutional right to due process.

I’ve gathered all the relevant jury instructions over at my Law of Self Defense blog (www.lawofselfdefense.com), and here will provide a brief overview and a link back to the full-length instruction there.

FLJI 7.4 Murder–Second Degree

Florida Jury Instruction 7.4, Murder–second degree, is based on Florida statute 782.04, section (2) of which covers second degree murder.

Second degree murder has been the primary criminal charge against Zimmerman since the initial affidavit of probable cause. It’s requirement that Zimmerman must have acted with the characteristics of a “depraved mind” –hatred, ill-will, or spite directed at Trayvon Martin–and the absence of evidence of that state of mind has always made it unlikely that the State could obtain a conviction on this charge.

In Florida manslaughter is a lesser-included charge of second degree murder, so it was always inevitable that the jury would be read this instruction as well. Here, it is quite possible that the State may be able to prove the elements of the crime beyond a reasonable doubt–essentially that Zimmerman deliberately used force against Martin, and that Martin died as a result.

The challenge for the State, then, comes in the second half of the analysis in any self-defense case, and that is where the defendant claims that, yes, he did commit the acts with which he was charged but he was legally justified in doing so because he was acting in lawful self-defense. Self-defense is an absolute defense against conviction of any intentional crime, if accepted by the jury as true.

Florida Jury Instruction 3.6(f): Justifiable Use of Deadly Force

There had also been the suggestion that the State would seek to have the jury instructed on aggravated assault and/or aggravated battery. These charges are almost never brought when the outcome of the crime happens to be a dead person–that’s what murder and manslaughter are for. The State’s desire to include these, then, simply reflects a cynical effort to offer the jury something on which they could return a “compromise” verdict of guilt. In the end the State elected to not pursue these instructions.

The real shocker, however, came when the State sought to have the jury instructed on third-degree murder, the first time in this lengthy trial that this particular charge has been mentioned. Third-degree murder involves a killing with an underlying felony, and is included in the murder jury instructions.

In this case, the State is arguing that because Martin was 17-years-old he was a minor, and therefore Zimmerman’s act of shooting him was an act of child abuse. It appears initially that Nelson may be amenable to instructing the jury on this preposterous charge. Doing so would simply add to the mountain of improper decisions this Judge has made that will certainly result in any guilty verdict being overturned on appeal.

There has also been some wrangling on specific language each side has desired on such issues as “provocation” and “serious bodily harm,” and for the most part Judge Nelson has seemed to discard the desired variation on the standard jury instruction.

Instead, too many black Americans have allowed themselves to be manipulated by the liberal media and self-serving politicians to become a lynch mob, threatening violence if the trial doesn't convict.


Of course, the whole point of a "lynch mob" was that there was no trial, something I doubt needs to be explained to black folks in Florida, where actual lynchings used to take place.
