Americans have been convicted of more serious crimes with less evidence. The fact the complainant has a rather shady past should not mean anything, since past events are not related to this one.

According to news reports this morning on national BBC radio, the maid has too many flaws in an uncorroborated story to secure a clear conviction.

How much of this is legal twaddle is unknown, but I suspect that each side is playing silly buggers to discredit the other, rather than concentrating on whether he did it or not.

I suppose one could argue a case for the French having master-minded the lot so he didn't stand in the election, but that would be too daft; wouldn't it ?

No, I don't think that's daft at all. But I don't see any more real evidence of that than of some of the other possibilities.

They do know there was sexual intercourse because of DSK's semen on her clothing. She says it was rape and he says it was consensual. Personally, I doubt it was consensual, since everything happened in such a short space of time and because of her torn clothing. I do know that Mike Tyson was convicted on less evidence of guilt than there is in this case.

I also note how DSK is defending himself by impugning her character, which I thought was generally contrary to the usual rules of evidence. The local newspapers are wholeheartedly going along with him in this instance. I guess if you're enough of a big shot, the laws don't apply the same, especially if you're a Socialist. :(
 
French thinks it's ok for the rich of famous to sexualy assault people. Straus should be put on trial, Polanski should be in jail for child rape.

That might be one of the most ridiculous statements you have made in this forum. Rather, it sounds like you are the one trying to impugn the Defendant's character based upon his politics.

In any event, the credibility of any witness can always be impugned in any proceeding. This is especially true when the witness has admitted to previously making a false accusation of rape under oath.

Most states do have statutes which limit the types of inquiry that may be made into the history of the accusing witness. But those limitations are designed to exclude evidence of her sexual past, so as to prevent the defense of painting the victim as a wanton whore.

But when the witness is an admitted liar, that evidence is always going to be admissible.

One point I do agree with is that justice for the wealthy bears little resemblance to the justice available to the indigent. DSK has no doubt hired a team of high-priced lawyers who are very good at rooting out facts which may create a reasonable doubt in the mind of the jurors. The prosecution knows who they are up against, and knows that DSK's counsel will tear the witness to shreds in front of the jury based upon her prior lies. She has credibility problems which would have a public defender licking his chops. DSK's attorneys are positively salivating.

Not exactly. They condone their politicians having extramarital sex--in fact, they give them extra credit for it (if they are males). They also condone people in the arts doing all sorts of sexual things (which is the Polanski tie in. It isn't the same attitude as if he were a political leader). That doesn't mean they condone sexual assault.

This isn't quite either one of those cases. The maid's background--and subsequent actions--cast doubts and make it a "he said/she said" issue.

We can't, though, say that the French forgive this conduct--to the extent that he has admitted, which shows bad judgment at least--until/unless he goes ahead and runs for the French presidency and wins, now can we?

International figures? Not their political leanings, no. But their international stature and how the United States will be perceived in dealing with them? Yes, certainly.

There are always additional pressures on judges in high profile cases. But Box's argument that DSK's socialism is a factor giving him preferred treatment is just silly.

You surveyed the NY newspapers in the wake of the event, did you? I'll bet not. I'll bet your stupid statement here would have choked off in your throat if you had.

Earth to Boxlicker: a radically socialist rag anywhere would have supported the maid from the get go and would continue to be supporting her.

So, do you even have a hint of what socialism is?

The prosecution has determined that it cannot prove the case beyond a shadow of a doubt. Why? Because the accuser is an admitted liar. She has lied about rape in the past. She has lied on her tax returns. She lied in her account to the police about what she did following the alleged rape. She lied to the prosecutors about deposits in her bank accounts.

This case is a classic "he said/she said." The defense will show that you cannot believe anything she says by parading every one of her lies in front of the jury. No prosecutor wants to invest the time and energy into a case where the complaining witness cannot be believed. She lied about everything else, but she's telling the truth now? Come on! Its a waste of time.
 
But if he doesn't run for office in France now, somebody won out--and doesn't really care about the legal outcome. That's why I don't completely discount political hanky panky. (I've sat in on sessions that were planning it.)

He's not coming out winners in this one way or the other. And the maid isn't likely to come out any worse than she started out. That doesn't make me feel the least bit sorry for him, of course.

I think she was convicted of those things on the same day not one but both of the discredited girls that, that piece of garbage they call a quarterback in Pittsburgh assaulted were convicted.

and Pilot does have a point with the Kennedy's. Murder, the church annulling after years just so the asshole could remarry, and a long list of shit that leaves me with no pity whatsoever for the "tragedy's" that that depraved family has endured.

They were cursed way back in Ireland for a reason.
