Republicans Move To Impeach Judge Boasberg

He signed an illegal subpoena as a FISA judge, as well as those presently in question by legal minds in the Senate, as a District Court Judge.

Can a judge do that? Yes. Can a judge place a gag order on the parties? Yes.

The key here is not only why Boasberg did it, but whether a judge can ignore/violate the law when he does it.

Boasberg is going to argue intent matters and he didn't intend to violate anyone's rights or ignore the law. As to the first; if you violate someone's rights, you violated their rights and your intentions are irrelevant. If yo used your governmental powers in the course of those violations, your immunity will not protect you.

As to the second, here's where things get sticky. Judges often make mistakes in their decisions and either get the law wrong or apply it wrong or aren't aware of it. Those aren't criminal acts.

So, the case isn't all that strong but it does have some meat in it. How much depends on the DOJ, the district where the case is to be tried, and the jury pool as well as witnesses.

I'm not sure he'll beat the rap but it'll be close.

But can he place a gag order to conceal his own criminal activity in a conspiracy? I don't think so.

Anti-Trump Activist Judge James Boasberg ‘Likely’ Violated Federal Law to Help Deep State Spy on Republicans

November 3, 2025 - 3:12 pm

An anti-Trump Democrat-aligned federal judge is facing mounting backlash after approving a Biden DOJ-backed effort to secretly obtain the private cell phone data of 11 Republican senators, a move legal experts say may have violated federal law.

Chief Judge James Boasberg of the D.C. District Court, a Barack Obama appointee, reportedly signed secret orders in 2023 preventing cell carriers from notifying Republican lawmakers about special counsel Jack Smith’s subpoenas.

Those subpoenas sought phone records from January 4 and 7, 2021, as part of Smith’s investigation into President Donald Trump’s challenge of the 2020 election results.

The subpoenas demanded “detailed records for inbound and outbound calls, text messages, direct connect, and voicemail messages” from multiple Republican senators.

But can he place a gag order to conceal his own criminal activity in a conspiracy? I don't think so.

You'd have to prove two things; his crimes and that he intended to conceal them by the gag order.

Hard row to hoe that one.

Republicans Move to Impeach Judge Boasberg for Enabling Jack Smith’s Arctic Frost Scandal.

IN FULL
Republican lawmakers in the House of Representatives are now working to pursue the impeachment of U.S. District Court Chief Judge James Boasberg, who—along with his colleague U.S. District Court Judge Beryl Howell—issued non-disclosure orders preventing public knowledge of nearly 200 subpoenas targeting Republican organizations, officials, and donors filed by former Special Counsel Jack Smith. Late Thursday evening, Representative Brandon Gill (R-TX) announced he is drafting articles of impeachment against Boasberg. Rep. Byron Donalds (R-FL), likewise, signalled he would pursue impeachment. It is unclear whether Judge Howell will also face impeachment.

The National Pulse reported on Wednesday that Jack Smith issued 197 subpoenas targeting over 430 Republican groups and individuals as part of the Arctic Frost probe. Senator. Chuck Grassley (R-IA) described the investigation as a “fishing expedition” aimed at improperly scrutinizing the Republican political apparatus. Among the subpoenas were requests for telecom carriers to provide Smith’s team with cellular data for around a dozen Republican lawmakers, with Boasberg and Howell’s orders preventing the companies from disclosing the requests.

“Radical activist judge James Boasberg continues to weaponize his judicial authority and target his political opponents,” Rep. Gill said in a statement. “Judge Boasberg facilitated the egregious Arctic Frost scandal, where he equipped the Biden DOJ to spy on Republican senators. His lack of integrity makes him clearly unfit for the gavel.” Boasberg, appointed by former President Barack Obama and now serving as chief judge in Washington, D.C., has faced prior criticism for rulings that impacted Trump administration policies.

Troublingly, under the guise of investigating the alleged involvement of President Trump and several Republican lawmakers in January 6, Jack Smith—enabled by judges Boasberg and Howell—appears to have, in reality, laid the groundwork for an unprecedented, weaponized, and partisan criminal probe aimed at crippling the Republican Party. Financial institutions and political vendors for Trump-aligned PACs were targeted with subpoenas, suggesting that Smith sought to establish monetary links between hundreds of consulting firms, advisors, and nonprofits that he could subsequently prosecute—presumably under the Racketeer Influenced and Corrupt Organizations (RICO) Act—if he had secured a conviction against Trump.

About fucking time.

Arent YOU the one who is always bitching about "Lawfare" when it's against Trump?

What's your take on this, then?

Oh right, "it's okay as long as Trump himself is doing it. That's how authoritarian dictatorships are SUPPOSED to work, you dummy!"
I presume you weren't born stupid. It's lapping up ahh the leftist bullshit that has made you that way.

This is not "lawfare," asshole. This is making sure that this abuse of power can't happen again.

Stay tuned, stupid, there will be more of this as the DOJ cleans house on these corrupt, treasonous judges and politicians.

Call it revenge if you want (it isn't), but without accountability and consequences, this type of of unlawful and unconstitutional atrocity will be allowed to happen over and over.

For a guy who claims to be a lawyer, not that anyone believes you of course (since you repeatedly have demonstrated you can't possibly have passed a high school civics class, let alone attended law school) you are remarkably dense.

This is how YOU BELIEVE the law in America works:
1) If you are the president, or well connected to the president, then "do what thou wilt shall be the whole of the law," and
2) If you are not the president or the well connected, then it is the duty of the State to rule over you with an iron fist, and you belong, body and soul, as a slave to the state.

THIS IS NOT HOW THE AMERICAN LEGAL SYSTEM WORKS.

Trump repeatedly, brazenly, brashly, and openly broke the law.

There are, and should be, consequences for breaking the law. Yes, those consequences should apply to Trump, just as they should apply to an illegal immigrant stealing from an ICE cream truck.

You seem to be missing that part. Or else, you seem to conveniently ignore that part. Nobody- NO, NOT EVEN THE PRESIDENT, is above the law or the constitution. Not in America. Not in any democratic free society. Which is what America is.

Why don't you go back and finish high school and stop pretending you know how the legal system works. You DONT.

"Revenge?" How about "INJUSTICE!" It is an injustice, a travesty, that Trump is currently a free man and allowed to hold public office. According to the U.S. CONSTITUTION (about which you know nothing) he technically should not! How about that??

I like the Constitution and the Republic it stands for.

We are not a democracy. We are a Republic.
Yeah yeah, you know what I mean.

As for the rule of law I look forward to seeing it applied equitably to Judge Boasberg and the rest of the plotters who tried to foist a coup against a duly elected President.

I also look forward to them receiving the perfectly lawful death penalty as it may apply to their acts of treason.
Deflections. You can’t be a MAGAt and support rule of law. What you support is the selective use of law to punish those who speak out against or act in legal and actual rule of law opposition to Dear Leader.

How do you prove intent of abuse of power?

Forget impeachment with the present political climate. Boasberg could commit murder and democrat senators would vote NO to convict. Although he could be prosecuted in trial court but my point is the political mechanism for impeachment is locked in political partisanship.

Somedays I feel our judicial system is unraveling and ineffective due to political partisanship. Since 2015 I've been watching democrat lawfare.

Go fuck yourself! Democratic party is synonymous with selective prosecution and bastardization of the constitution.

How do you prove intent of abuse of power?
Making up emergencies that don't exist.

For example - when the term invasion is dependent on a country performing the invasion and an invasion is declared without any country doing the invading.

They could technically bomb all the homeless shelters in the name of "war on poverty." Although I am sure they've thought of that idea.

Lake Ontario already has an international name.

Perhaps they can re-rename Gulf of America back to Gulf of Mexico.
