The cop had every authority in the world to search Luigi's person when he was arrested. No argument there.

But a warrant was needed for opening and searching a backpack. Just the same as a warrant is needed for searching his home, his car, his phone, his storage unit, or etc.

The motion may well succeed.

I've seen cops search bags all the time when they stop a person of interest. Especially if that person is suspected of possessing drugs or guns. Do they have to ask first?

Depending on the state and the circumstance they likely have to either obtain consent or else obtain a warrant. They can justify a search under exigent circumstances like if they suspect a bomb is in the backpack.

Otherwise if they have the backpack in custody they're better off waiting for a warrant to search it. Otherwise the evidence might get tossed.

I google stuff listen to people (yourself included believe or not) who have greater understanding of various topics than myself and see what's what. So what is your guess?
