The probatory ability of the President is defined in the law. If you want to change that, change the law. Truth be told, the Executive has too much ability to be flexible in their interpretation and Congress should address that.

Lets be clear that all the kerfuffle about immigration is directed only at one specific group of immigrants- i.e. Mexican and Central American natives.
