Apparently Garland has now admitted to Congress that he had no authority to appoint Smith as a special counsel because the special counsel statute had expired prior to Smith's appointment. There's also some issue regarding Garland creating a government department and appointing Smith to head that department (in lieu of being a special counsel) without Smith first being nominated by Biden and then confirmed by the Senate. Which would be unlawful.
If true, that's a big oops.
