The debate over fetal rights is not new to the legislative arena. Every year pro-life and pro-choice advocates vie for the upper hand in this contentious issue. In recent years, states have expanded this debate to include the issue of fetuses killed by violent acts against pregnant women. In some states, legislation has increased the criminal penalties for crimes involving pregnant women. These laws have focused on the harm done to a pregnant woman and the subsequent loss of her pregnancy, but not on the rights of the fetus.

Currently, at least 38 states have fetal homicide laws. The states include: Alabama, Alaska, Arizona, Arkansas, California, Colorado, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Nebraska, Nevada, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, Washington, West Virginia;and>Wisconsin>. At least 23 states have fetal homicide laws that apply to the earliest stages of pregnancy ("any state of gestation," "conception," "fertilization" or "post-fertilization");

These laws have focused on the harm done to a pregnant woman and the subsequent loss of her pregnancy, but not on the rights of the fetus.

Sigh. Way to twist the intent of the law. It is so the woman - who wanted to carry to term to have a baby - has legal recourse. It's not about elevating the rights of the fetus above the rights of the woman. It's about giving the woman more legal rights and it treats the fetus as her possession - and giving compensation for that loss.

We can look at each of the 38 states with laws against feticide, but I thought Georgia might be a start...

Ga. Code Ann. § 16-5-80 defines feticide. A person commits the offense of feticide if he or she willfully kills an unborn child so far developed as to be ordinarily called "quick" by causing any injury to the mother of such child. The penalty for feticide is imprisonment for life.
Ga. Code Ann. § 40-6-393.1 defines vehicular feticide and provides for penalties.
Ga. Code Ann. § 52-7-12.3 defines the term "unborn child"to mean a member of the species Homo sapiens at any stage of development who is carried in the womb. The law defines feticide by watercraft in the first and second degrees and provides for penalties.

If the crime is assault on a woman with a loss of cells, why is that a life sentence? If you stab someone, and it results in the loss of their spleen you don't get life in prison.

Legal recourse to do what?

Legal recourse for the no longer pregnant woman to protect her property (her fetus) rights in the event of someone causing her to lose it because of violence perpetrated upon her - so the person that caused her to lose said wanted property (her fetus) can be punished by the law.

This isn't rocket science.

Isn't that ever so supportive of my prior argument about slavery and the ownership of another human being? Are we going to be seeing the US government compensating the descendants of slave-owners now for the loss of their property?

No to John McCain because I never did know his middle name of my poor excuse for a Senator, yes to Willard because Willard was also a name of a good friend of mine. I routinely refer to Nixon as Richard Milhous Nixon. Actual presidents have often been known by their full names that is certainly the name that's always on their Presidential Library. I don't recall Ford's middle name but it's John Fitzgerald Kennedy, Ronald Wilson Reagan and James Earl Carter. Off the top of my head the only losing candidates that I can think of their middle names are Barry (Some people call him Maurice) Goldwater and Hillary Rodham Clinton.
