Why can the Government fuck over Native Americans?

The Pipeline and Hazardous Materials Safety Administration issued a corrective action order to Belle Fourche, part of True Cos. of Wyoming, stemming from its investigation into the spill discovered Dec. 5 by a landowner northwest of Belfield.

The oil pipeline under investigation was built in the 1980s, but it’s believed the segment that failed was installed in 2013, the agency said.

The spill was not detected by monitoring equipment on the pipeline. PHMSA inspections in 2004 and 2009 showed that portions of the Belle Fourche’s pipeline system lacked accurate or timely leak-detection systems, the agency said.

PHMSA also noted that this pipeline falls under the same corrective action order the agency issued in January 2015 to True Cos. following the oil spill in the Yellowstone River that temporarily contaminated the water supply for Glendive, Mont. The agency said the response plan submitted under that order was “deemed to be inadequate.”

BISMARCK, N.D. (AP) — Staffers with the North Dakota Public Service Commission say there's no doubt the developer of the four-state Dakota Access oil pipeline violated rules regarding reporting Native American artifacts.

Via attorney John Schuh, the staffers urged the three-member commission last month to move the case against Dallas-based Energy Transfer Partners forward, saying the company's arguments against a proposed $15,000 fine are flawed.

The PSC maintains that ETP subsidiary Dakota Access LLC failed to get its approval before proceeding with construction in October on private land in southern North Dakota after the artifacts were found along the route.

I do believe the original native Americans got a raw deal but, they were fighting and killing each other over land WAY before any Europeans landed. Imagine if they had UNITED instead and all of them defended they land they mutually shared...

America could be TOTALLY different...

In asking a judge to speedily green-light the $3.8bn project, vice-president Joey Mahmoud claimed that the loss of shippers could “effectively result in project cancellation”, leading advocates and analysts to declare that a missed January deadline could be financially disastrous for ETP and a huge feat for Standing Rock.

But in emails to the Guardian, DAPL spokeswoman Vicki Granado claimed that January was just an “initial target” and not a “contractual date”, which is “much later”, though she refused to say when.

Her statement, which contradicts the company’s official court testimony on multiple occasions, has prompted accusations that the corporation has either committed perjury or is lying to reporters. (Granado claimed that the court filing didn’t explicitly say that 1 January was a contract deadline even though the language strongly suggested it was.)

A federal grand jury has been convened pertaining to Sophia Wilansky, the 21-year-old New York woman who nearly lost her arm during a November pipeline protest, according to court documents obtained by the Tribune.

The woman's father, Wayne Wilansky, has claimed the injury was caused by an alleged concussion grenade thrown by police. Police said they had no such weapons.

There were many states participating in the anti protesters operation.

Many states sent militarized police and militarized resources to the protest site.

How can the local sheriff account for what the other state's forces had in their inventory?

A Clinton-era directive used mainly for natural disaster relief has drawn in law enforcement from faraway states

The deployment of military-grade equipment, including land-mine-resistant trucks and armored personnel carriers, as well as the use of pepper spray, rubber bullets, and alleged strip searches led Standing Rock Sioux tribal chairman Dave Archambault II to ask the Justice Department to investigate civil rights abuses. "Local and state law enforcement have increasingly taken steps to militarize their presence, to intimidate participants who are lawfully expressing their views, and to escalate tensions and promote fear," Archambault wrote in his letter.

Some of the police details that have arrived in Standing Rock are among the largest recipients of military transfers from the federal government, according to an In These Times investigation. The South Dakota Highway Patrol has received $2 million worth of military equipment since 2006. The Lake County Sheriff's Office in Northwest Indiana obtained $1.5 million worth of military equipment over the same time period. The Pennington County Sheriff's office in South Dakota, the Anoka County Sheriff's office in Minnesota, and the Griffith Indiana Police Department have all received assault rifles through military equipment transfer programs as well.

The private security team hired from pipeline officials in Texas showed contempt and open dislike toward the protesters.

The security team members were "helping" the police forces by harassing the protesters in ways that endangered the protester's lives.

The militarized police took a violent approach, when they invaded the protest camps.

They were brutal in their arrest of protesters.

Disease brought over by the earliest European explorers reeked havoc on native social groups before colonists showed up. Natives are human too with the same faults as Europeans. Europeans made promises to help a tribe defeat another tribe and they agreed. Also how Britain took over India. Was not long before colonist population and high birth rate made them superior. Natives could not afford to lose a few hundred males in a battle.

Tecumseh was the natives last chance at unification. He was killed at the Battle of Moraviantown in 1813.

Are they going to give back the checks from the white men this month?

In 1990, the Supreme Court of Canada in the Sioui case determined that "treaties and statutes relating to Indians should be liberally construed and uncertainties resolved in favour of the Indians." In that case, the court introduced into Canadian jurisprudence a principle adopted from a 19th-century ruling in the United States that such treaties "must therefore be construed, not according to the technical meaning of its words to learned lawyers, but in the sense in which they would naturally be understood by the Indians."

In spite of the constitutional character of treaties, these deals were often viewed cynically by those non-Indigenous people responsible for both making and implementing them as cheap and expedient ways to strip Aboriginal title from most of the lands in Canada so that resources could be exploited by other groups.

Nothing like white liberals whining and saying simplistic things about complex issues.

President Trump and his all-white staff are seen here, following the signing of Executive Order TRUMP2476, which will enable pipelines to be laid anywhere in the US that he wants to lay pipe.

Provisions of the order will override the objections of the Army Corps of Engineers, the Department of the Interior, The Environmental Protection Agency and several sovereign nations of Native Americans. Thanks for listening, Donald!

The threats to safety, security, the threat of terrorism... all great gateways.

Safe spaces galore.

Standing Rock Sioux Chairman Dave Archambault II requested a meeting with President Trump to discuss the implications of the pipeline. Naturally, he has yet to receive a response.

Conflicting, chaotic accounts spilled out in the wake of the arrests on February 1 of a few dozen of the water protectors who set up a small camp they named the Last Child Camp. What can be ascertained is that unlike Oceti Sakowin, it was on private land, not federal land, and this gave authorities the legal right to move in and eject them. According to the Morton County Sheriff’s Office, they were told beforehand to clear out the new camp.

Standing Rock Chairman David Archambault II noted that the new camp had been established after an announcement by Sen. John Hoeven, R-ND, that Acting Secretary of the Army Robert Speer had directed the U.S. Army Corps of Engineers to grant the last remaining easement for Energy Transfer Partners to drill under Lake Oahe. This turned out to be erroneous, and it remains unclear whether Hoeven, who was recently named chairman of the Senate Committee on Indian Affairs, had been misled, or knowingly told a falsehood.

The Corps (Army corps of engineers)is supposed to walk away from the process already underway, the Environmental Impact Statement and the public comment period that is open until February 20, 2017. (However a spokesman for the Corps said that process will continue and the easement has not been approved yet).

First: It’s interesting that this announcement came from a U.S. Senator and not the agency itself.

Will federal judges tell the president no? Will litigation even be allowed (strange as those words sound)? The Trump administration and North Dakota certainly hopes not. That process takes too long in a world run by oil gadzillionaires.

A statement by the Standing Rock Sioux Tribe Tuesday said: “The Army Corps lacks statutory authority to simply stop the EIS and issue the easement. The Corps must review the Presidential Memorandum, notify Congress, and actually grant the easement. We have not received formal notice that the EIS has been suspended or withdrawn. To abandon the EIS would amount to a wholly unexplained and arbitrary change based on the President’s personal views and, potentially, personal investments. We stand ready to fight this battle against corporate interest superseding government procedure and the health and well being of millions of Americans.”

Water protectors claimed that evacuation orders issued on February 15 did not give them enough time to finish clearing the debris on their own. They said they were doing fine without being pushed out, and that the move by newly elected Gov. Doug Burgum misrepresented and undermined the success of their efforts.

North Dakota officials had used numerous excuses over the months to justify the over-militarization of the police presence, then in trying to push water protectors off the treaty lands. At first it was the expression of concern over the cold winter, and then it was the impending spring floods, Goldtooth said.

“Water protectors have been through three blizzards, and there have been no deaths, no injuries” other than what the military police have inflicted on them, he said. “And now they’re using this flood as a way to get people off the ground.”

Will we find out what really happened ?

This paper does not side with Water Protecters.

February 22, the Oceti Oyate camp, formerly known as Oceti Sakowin, as well as all other camps on treaty land claimed by the US Army Corps, were ordered to evacuate by 2pm.

Ten unarmed water protectors were arrested and one was badly injured in a violent crackdown. Several of those arrested were journalists and legal observers, clearly targeted for their role in documenting police violence and rights violations.

Another water protector was tazed by Bureau of Indian Affair agents in the lobby of the Prairie Knights Casino.

A horrible joke, authorities warn of the danger of snow melt washing human excrement into the water table, when the true water protecters cry out against the permanant poisoning, because of a pipeline spill.

Back to the OP, because we don't owe them anything, anymore. If you see how they treat their own lands and the destruction and disregard that they have for where they live. You would understand. The only time they pretend that they care is just an avenue to pull some more money from you suckers. I remember that commercial from my youth of the old Indians tears from the trash. My god, he is rolling over in his grave at the destruction and trashing of " scared " grounds now. So sad.

Don't ever look to phrodo and slushy for the truth. They have never even dared to venture out of their secure, libbi hoods to see what is going on in the real world. Sure, if you need someone to pull up statistics or information to make themselves feel better about their opinions, by all means, that's your flake team. Otherwise, go check it out for yourself. I see it every day.

Water protectors?! WTF? You snowies are so fucking clueless. Let's camp out, burn shit, trash shit, shit on the shit and blame someone else for trashing our sacred lands. Damnit, they made us leave early. Oh well, I'll go to the post office and see if my assistance checks have came in. We'll let someone else clean up this shit, literally.
