Music Industry Wants Royalties From iTunes 30 Second Samples

Music royalty groups ASCAP and BMI are harassing online music stores such as iTunes to pay performance fees not only for the songs that they sell, but for the short clips that they use as previews. You know, the things that entice people to pay for music. They want to be paid for advertisements for their product.

I was looking into that and I saw on the website for musicbizacademy that the rate goes up incrementaly every two years for songwriters or how the label will pay mechanical royalties aka controlled composition fees. The article stated that as of 2008 the fee was 8 cents. I guess you have to sell a shitload of records to make that work for ya.
On a side note, I have a buddy who just received his masters in studio production... He gave me a bit of a short breakdown of the music biz which to my untrained eye looks more like a mobster movie. Its a dirty, dirty industry with the big fish at the top gobbling up all the big money and the small time artist are suffering and scraping by daily each hoping they can get a chance to get "signed" which just means that the company is going to front you the money to produce your next record or two. There is a nondescript point system that lays out how much the company will pay for a song and nearly every artist out there has to rely on their second or third album to make money for them as the profits from the first are going to pay for production and promotion of the collective image and cds. Many artist have bands that break up, and leave them with scads of debt to the label (in one article in GuitarWorld, this guy was like 22 years old and owed 97k to a label cause his band broke up and left him in breach of contract with no way to recoup the costs).
Do I think songwriters should make more... of course I do, but charging for song fragments is just lame and will further alienate the record labels from musicians and fans alike.

Performers & songwriters deserve to be paid. It's there music. Do you work for free? Do you make a product and sell it for free? I doubt it. It's the same principle.

I think he knows that - and the performers DO get paid for the downloads from iTunes & similar services. The article is about performers wanting to get paid for the advertising that these services provide, AS WELL AS the full song.

Now, I freely admit that I have no business sense, but I always thought that advertising was something that people paid for, rather than got paid for?

Tough shit. "Fair Use" includes publishing "portions" of copyrighted work (as opposed to the entire thing).

I don't want to go back to the days when you took a gamble at the record store, not knowing if you were buying one good song and nine pieces of shit.

Even the grocery store deli gives out a free slice of lunch meat so you can try it.

I've been burned enough times buying a cd after hearing one track, only to find out that the rest of it sucks ass big style, so those 30 seconds of preview are important to me...

Can't the record companies realise that people need to hear somthing before they want to buy it, and that not everything gets radio airplay?
