I'm not into fan fiction. Never read any, never written any, but I am curious about Literotica's stance.

Yes, but only in the Celebrity category and with some provisos, for example that erotic stories cannot be written about characters that are under age 18 in the original production.

Non-con is not allowed with either celeb or fan fiction stories. It was at one time in the past, and some of the stories remain, but any new works featuring non-con are routinely rejected.

Stories featuring real political figures as protagonists are also rejected, and have been for a few years now.

As Ogg said, you can't "age up" characters that never reached 18 in the original material. This also applies to characters that are only shown briefly as over 18, such as Harry Potter characters. That's only a minute or two out of umpteen books/films. The primary focus of the original material is under-18 characters.

That seems to extend to characters depicted as adults in the original material, because the underage characters are the primary focus. It more or less makes all Harry Potter off limits.

Where the age of the characters in the original work is ambiguous, they're more often approved than not, unless the characters in the fanfic are acting underage.

There's also the matter of Laurel being familiar with the original material. If she doesn't know it, and the characters aren't acting undarage in the fanfic, it may very well be approved regardless of the ages of the characters in the original material. If it is then reported by someone who does know the original material, it may be rejected after the fact, and subsequent fanfic from that original material will get rejected as well, when recognized.

It's one of the more complicated sets of rules to navigate on the site. Often, because it isn't particularly popular, people simply don't bother. They can get more mileage out of other sites where fanfic is the primary focus.

There's a category named "Celebrities and Fan Fiction".

Non-con is not allowed with either celeb or fan fiction stories. It was at one time in the past, and some of the stories remain, but any new works featuring non-con are routinely rejected.

Are you sure of that? On a quick search I found two published within the last year, both in Celeb/Fanfic, that have obvious strong non-con.

The latter is tagged "nonconsensual", "sex by force" and "women raping women", so I doubt it slipped through by accident.

There may well be a policy of not allowing NC related to RL celebs but it doesn't seem to extend to other fanfic, even with fictional characters who are played by RL actors.

That falls short of "all fanfic", though. It doesn't cover fanfic that only uses original characters (e.g. the Star Wars example I linked) and "copyrighted characters" is not the same as "any character from a published work".

The law relating to copyright protection of characters is complex and rather subjective. See discussion here and here. In brief, distinctive characters who are crucial to the story are likely to qualify, but others may not; the bar is set high enough that Sam Spade didn't qualify for copyright protection. For maximum protection, better to trademark a character rather than relying on copyright.
 
As I said, it's the most complex set of rules on the site. :D

The prohibition outlaws far more possibilities than it allows, regardless. So assuming non-con ( which has a murky line even without the celeb/fanfic component ) isn't going to fly is a reasonable way to put it.

Good point there. Here's two non-con stories that some how slipped through the filter a few years ago and even have the tags for it. I was surprised these were published since it involves a real life celebrity and not a fictional character.

I had to look up who Jilnar Jardaly is. She wouldn't be flattered by those stories, but there is a price for being a public figure.
